- The Munich District Court thwarted the bill for a TU student who quit his apartment in Garching without notice "for an important reason".

After the students were banished to the home office and the lecture halls were closed due to the pandemic, the student no longer saw any reason to stay in Garching.

The young man, who studied at the TU in Garching, had rented the furnished student apartment near the TU since August 2018.

On April 14, 2020 he was informed by the university that due to the corona pandemic, the course would no longer be offered in face-to-face operation until further notice, but only in digital form.

The next day he gave notice to the landlord, put his seven things together, cleaned and returned the keys.

After all, he could just as easily study from home in Frankenthal via the Internet, the young man argued to the landlord.

As a student, he would have had to spend a lot of money to purchase the technology for online studies, so he couldn't afford to finance living space that he didn't need.

He justified himself as having just as little to blame for the situation as the landlord, but he was economically weaker.

The leasing Grünwalder company adhered to the notice period and sued him.

The district judge agrees with the landlord: The judge ruled that there was no reason for termination.

The landlord only has to take care of the usability of the rented property.

The apartment can still be used despite the pandemic.

The district court sentenced the student to pay four months' rent totaling 3280 euros. In return, his landlord had to transfer the deposit of 1860 euros back to him.
