Although his defender denied that he had tried to do justice on his own, the 25-year-old arrested for running over and killing two thieves in Rosario remained in

preventive detention for 60 days

.

This Sunday he was charged with

simple homicide as

a result of the persecution in search of those who had assaulted him.

A video became the

key test

to refute the hypothesis of an accidental death or excess in self-defense.

The prosecutor Patricio Saldutti admitted that the exact route between the six blocks that separate the house where the armed robbery occurred and the corner where the crash occurred could not yet be established.

However, he presented a recording of a camera located in the latter place, which shows that

the driver

attacks the criminals from behind

when they climb onto the sidewalk in the ochava.

Judge Román Lanzón considered that the filming is "strong enough to know that anyone who drives a vehicle

could not have had any intention other

than to produce the result of death."

However, he added that then the "mental, emotional and cognitive state" of the accused should be analyzed.

At the request of the defense, the young man will be transferred this Monday for a first interview by a psychiatric board.

During the hearing that was carried out by videoconference, Diego Claudiano listened in silence and his lawyer ruled out that he would make any statements.

Pablo Rajmil spoke for him and asserted: "

All he wanted was for the police to catch the thieves

."

Thus, he stated that his client "acted under the principle of legitimate defense" after they put him on his knees "simulating an execution" at gunpoint to extract a backpack with 2,000 dollars.

Relatives and friends of the young detainee asked for his release.

"Diego gets into the truck so that they do not escape. There was no intent to kill because such action caused him to neglect his own life, he was miraculously saved," said the defender.

According to the evidence obtained so far by the Public Prosecutor's Office (MPA), the young man suffered a cut on his forehead and another on his right wrist after running

over the thieves and crashing into a tree

.

Diego Quiroga (25) died on the spot after lying under the pickup truck, while the death of Luciano Escudero (29) was confirmed the next day at the Clemente Álvarez Emergency Hospital (Heca).

The testimonies available to the investigators indicate that Claudiano was threatened with a 9-millimeter pistol and shot into the air at least three times, but there is still no "scientific" proof of this.

The driver's lawyer maintains that they

also pointed the gun at him while he was fleeing

and that is why he continued to drive "crouched, covering his head and body, with almost no visibility and the possibility of maneuvering."

However, the prosecutor Saldutti clarified that they still do not have elements to prove this part of the sequence, so they await the result of the material from another 16 security cameras in the coming weeks.
