Adriana Palliotti: who is the judge that complicates the Kirchners, Lázaro Báez and Cristóbal López

will turn ten years as head of the Federal Oral Court 5 (TOF 5), the same one that will have to try the Kirchner family for money laundering.

His voice was dissident

at the time of determining whether Cristina, Máximo and Florencia Kirchner should be returned to the hotels, the 26 properties and the companies accused of corruption crimes.

The Oral Courts of Comodoro Py are decisive when concluding a judicial process: in front of them the debates take place after which the accused are sentenced, as guilty or innocent.

There are eight in total, and half of them are incomplete.

The subrogances - substitutions - are for now the way so that some lawsuits can advance.

As a member of TOF 5, Adriana Palliotti was sworn in in September 2011. She had entered the Judiciary in 1984, and was in Morón until 1993, when she passed to Comodoro Py as secretary of the Federal Oral Court 6 (TOF 6) until she was competed to be holder of the position he occupies at present.

Recently,

Máximo and Florencia Kirchner asked that Palliotti be dismissed

from the two lawsuits that weigh on them and the vice president, all accused of having laundered about 130 million pesos with the real estate and hotels.

The judge was the only one who opposed returning the management of the companies still under suspicion and the administration of the properties that, according to the accusation, were acquired with funds of illicit origin.

Among other things, the magistrate argued that it

would have been important to know the position of the

complainant

Financial Information Unit (UIF)

in the case, but when the TOF 5 asked him to give an opinion on whether or not to restore the management of the assets and societies to the Kirchners, the government body chose by silence.

In favor of the Kirchners' request, Daniel Obligado voted - the same judge who reduced Amado Boudou's sentence by 10 months and granted him house arrest - and

Now it will be the members of TOF 5 who decide if they will make room for this new request from the Kirchner family to run to Adriana Palliotti.

Last month the judge was a member of the Court that sentenced Lázaro Báez to twelve years in prison for money laundering in the case known as Ruta del Dinero K. Together with Néstor Costabel, he considered that the crime preceding this money laundering maneuver was not only the apocryphal invoice plant used by Austral Construcciones, but also

the road contracts that businessman K received in an allegedly irregular manner.

This last file is in full oral trial by TOF 2, chaired by Judge Jorge Gorini, and the main defendant is Cristina Kirchner.

She was prosecuted during the investigation as the

head of an illicit association

 that defrauded the State by favoring Lázaro Báez with 51 bids for 46,000 million pesos.

The accusation highlights that

half of the contracts were unfinished, that 65% average cost overruns were applied

and that the tenders were "riddled with irregularities."

In that trial,

Adriana Palliotti is the fourth judge.

When it is estimated that a debate will last a long time, and for prevention, a fourth judge is appointed as a substitute, who only acts in case one of the three incumbents has any inconvenience in continuing.

This is contemplated in article 359 of the Code of Criminal Procedure. 

The magistrate who is now the focus of the Kirchners' criticisms ten days ago also opposed granting permission for Cristóbal López, prosecuted for defrauding the State for the multimillion-dollar debt of his company Oil Combustibles, to travel to Madrid on vacation.

It was the only dissenting vote, with which the businessman who is also accused in the Los Sauces case (the real estate company of the former presidential family) was 

able to obtain authorization to leave the country.

Palliotti also intervened in other cases, such as the conviction of

Guillermo Moreno

for the anti-

Clarín party

, and the money laundering cases against Ibar Pérez Corradi.
