The fact is, however, that a 50-year-old from Bad Tölz was sentenced to a suspended sentence for dangerous bodily harm.

Bad Tölz / Wolfratshausen - What was the reason that an Italian (50) was massively beaten up on a fellow countryman who was two years his junior remained vague.

The fact is, however, that the meeting had significant consequences for both parties: The 48-year-old spent three days in the hospital with a head laceration, a cut over the eye, a fracture of the nose and three broken ribs.

For his opponent, the big end followed six months later: The Tölzer was sentenced by the Wolfratshausen District Court to ten months in prison for dangerous bodily harm, the sentence has been suspended.

The defendant derived pedophile tendencies of the injured party from a photo

On August 26th last year, the two men met by chance at a gas station in Bad Tölz.

According to the indictment, the accused is said to have confronted his compatriot because of a photo from which he deduced the victim's pedophile tendencies.

He is said to have hit his counterpart in the face suddenly with his fist.

The victim fell backwards onto the cellar stairs.

When he got up again, it hit the face again.

The man went down again, where the accused is said to have kicked him several times in the stomach.

During the hearing, the defense attorney first took the floor and declared: "My client fully admits the allegations."

In response to inquiries by the court, the accused reported ongoing quarrels with the injured party, who had worked with him and his brother at the time.

"You have molested me endlessly," said the defendant.

When they met at the gas station, the 48-year-old immediately insulted him as a "bastard".

Then he hit him.

The photo named as a motif in the indictment was no longer mentioned at the hearing.

The injured party does not appear for the hearing

The injured party was just as unable to contribute to the clarification as the defendant's brother: Both did not appear for the hearing and, according to the court, are currently “of unknown residence” in their homeland.

Judge Helmut Berger sentenced Tölzer, who had not appeared under criminal law to date, to a prison sentence of ten months.

As promised in a legal conversation between the parties to the proceedings, he suspended the execution of the sentence for three years on probation.

As a condition, the currently unemployed bricklayer has to do 80 hours of social services.
