The reconstruction of Kwun Tong is in full swing. In early March, the URA issued a notice to move out to the left-behind Yumanfang merchants. Today (14th), a number of helmet-mounted bailiffs and security guards suddenly arrived at the scene and took back a shop. .

It is reported that the shop in question is held by Mr. Luo, who is nearly 70 years old.

Luo Sheng learned that the shop was suddenly closed, so he went to the scene to negotiate. The two sides collided for a while. Luo Sheng was emotional. In the end, the two sides stood in a stalemate. The negotiation broke down and the shop was taken back by the bailiff.

The concern group "Living in Kwun Tong" questioned the URA's approach or failed to follow the procedures, and suspected of sneaking away.

Other left-behind businesses expressed their worries that the bailiffs would "catch" at any time without prior notice.

The URA stated that at this stage, it has not arranged any further actions against the remaining merchants, and clarified that it is to follow the procedures of the Bailiff Office to recover the relevant shops.

Fung Ping Tak, the person in charge of living in Kwun Tong of the concern group, said that at 9 o'clock this morning, a bailiff suddenly arrived at the scene to take back the shop and blocked the entrance and exit of the shop.

The shopkeeper Luo Sheng rushed to the shop and was blocked from entering the shop. The two sides bumped into each other at one time. Luo Sheng was emotional. Later, he was arranged to meet with the senior staff of the Urban Renewal Authority, which lasted one hour.

Feng Bingde described that in the course of the negotiations, the representative of the URA had a tough attitude and kept changing the policy to persuade Luo Sheng, and explained to Luo Sheng that under the influence of various factors, he could only give him 1.3 million yuan in compensation.

Luo Sheng was dissatisfied with the compensation plan. Both parties talked about Luo Sheng’s life after his birthday and suggested that he receive CSSA to resolve it. Luo Sheng was emotional, and he expressed his dissatisfaction at the auction. He was even declared dead during the Yu Man Fang reconstruction project. Others persuaded.

Feng Bingde questioned the authorities’ closing procedures. He stated that the closure of the premises could only be carried out after three notices were issued. However, according to the merchants, the URA claimed that the first notice was issued on March 2, and the second notice was issued. At the end of March, the third time was today (that is, April 14), but the left-behind merchants stated that they had never received the end-of-March notice and questioned the URA for stealing the premises.

He also mentioned that the relevant requirement is to discuss the relevant matters with the shop owner again within 21 days before the last notice to close the shop, but the authorities have failed to do so.

Feng Bingde questioned the process of reaping.

After the disturbance, Luo Sheng's shop was recovered, and a notice was posted outside the gate stating that the shop had been recovered by the Secretary of Justice today. If anyone enters without the permission of the Secretary of Justice, the police will be investigated.

It was seen on the scene that the gate of the bunk had been welded, and the passage that had been blocked earlier was reopened. There were people wearing helmets standing outside the gate of the bunk, and people were also stationed outside the nearby URA office.

It is understood that the shop has been rented out two years ago, and it is currently not in operation. It is temporarily used as the shop owner’s warehouse.

Left-behind merchants worry that clerks can "get there" at any time

One of the left-behind merchants, Mrs. Zhang, who sells juices and snacks, said that she learned that Luo Sheng's shop was suddenly taken, and she immediately went to the scene to check.

After hearing that the senior URA was in the office, she planned to inquire about it. Unexpectedly, the staff refused to let her in and asked the security to stop her.

Mrs. Zhang and the security guard once collided with each other, and she felt her heartbeat speeded up and dizzy, so she needed to call an ambulance and rest in the white car without being sent to hospital.

Mrs. Zhang said frankly that he was worried about being sold out at any time. "I'm so afraid that he (the bailiff) will suddenly yell." "I have been tempted for decades, and I have never walked a step."

Mrs. Zhang cherishes the shop left by her husband very much, and only hopes to stay in the original place to continue living. She bluntly said that she would not accept any compensation or relocation proposals from the URA, and she intends to stay there until the end.

She pointed out that since June last year, FEHD staff have come to issue tickets on average every week, saying that shops cannot sell "egg waffles" and have to pay a fine of several thousand yuan each time. There has been nothing for a few years, and it started as soon as the court was over."

She suspected that the ticket application was related to the redevelopment of the shop. She had inquired about the food ring, but the other party denied that it was related to the redevelopment of the shop.

Another left-behind merchant, Xu Sheng, felt helpless when the bailiff suddenly took back Luo Sheng's shop. He also believed that the compensation provided by the URA was unreasonable. "I asked you to sell a phone to me. You are all unwilling."

He said frankly that he has no plans for the raid. "We will calculate first, and there will be nothing we can do. It's okay if you want to accept it. I only hope that the business will continue. There is no way to do it."

URA: This operation complies with established procedures

The URA replied that no further actions have been arranged against the remaining merchants at this stage.

Regarding the resumption of the premises today, the court bailiff visited the structure as early as early March this year and sent a "Possession Writ" (Order of Repossession) and a "Notice of Evacuation to the Occupant" to Mr. Luo, the occupant, requesting him Return the vacant possession to the government before March 9.

The court bailiff also visited the structure again on April 7, 2021 to review the situation, and sent the final notice of the "Writ of Possession" and the "Notice of Evacuation to the Occupant", requesting him to do so in 2021. Return the vacant possession to the government before April 14.

The URA emphasized that the court bailiff has complied with the established procedures. After the expiry of the last notice to move out, the “warrant of possession” issued by the court will be executed to recover the one on the ground floor of the Yuhua Building in Yuman Square that has ceased to operate. Of illegal structures.

The bailiff has made a list of the properties in the structure and handed it to the URA for record.

The URA will temporarily store the items (if any) in the structure, and the occupant can contact the URA to arrange to retrieve them.

After the government recovers the structure, in accordance with the current government land policy, under normal circumstances, the common area of the building on the private lot is occupied, and the use violates the land lease terms, the occupant will not be compensated or ex-gratia allowance; If the occupier believes that he has any rights or interests in the land, he can continue to claim compensation from the government. If the occupier fails to reach an agreement with the government, he can finally apply to the Lands Tribunal for a ruling.
