Safety distance: the PV must be precise

2021-04-15T17:04:19.388Z

RIGHTS OF THE USER - Case law is now well established in terms of fines for non-compliance with safety distances. The user can successfully challenge the PV in very specific cases.

The Highway Code requires the driver following another vehicle to maintain a sufficient safety distance from the vehicle in front to avoid any collision.

This distance is all the greater as the speed is higher.

In the event of an offense, the driver is liable to a fine of 135 euros, a driving license suspension of up to three years (white license possible) and the automatic loss of 3 points on his driving license. .

This offense can give rise to interception or even be drawn up on the fly by simply reading the vehicle's license plate.

The report may be contested in the absence of an arrest since the driver has not been identified (only the fine will be retained) and / or, in the event of an arrest, if the report is insufficiently written.

Indeed, the judges cancel the reports when they do not specify the concrete circumstances in which the offense was raised.

For good reason, it is not possible to contest an insufficiently detailed offense by the police: at what speed was the vehicle traveling?

What distance did he have to respect?

What non-regulatory distance was not respected?

In addition, according to the courts, the report must mention the kilometer point of the offense.

In the absence of this substantial information, the motorist is not able to assess with precision the traffic conditions and the places where the alleged offense was committed.
