Defendant Ma Chuhui (65 years old), a former full-time driver of Anzhun Co., Ltd., was charged with four counts of conspiracy to provide benefits to an agent, violating section 9(2)(a) of the Prevention of Bribery Ordinance and the Criminal Offences Ordinance Section 159A.
The defendant was a full-time driver of "An Zun" at the time of the case, and was responsible for transporting pork from the slaughterhouse to different meat stalls in Hong Kong.
The defendant was supervised by a manager, and the other party owed the defendant money.
Two of the charges allege that the defendant allegedly conspired with the manager to provide benefits to the other party during the period from February 1, 2018 to January 31, 2019, without legal authority or reasonable excuse, so as to prevent the manager from repaying 5,000 per month The legal liability for the loan of RMB 7,000 or RMB was used as an incentive or remuneration for the other party to assist the defendant in continuing to be employed by Anzhun.
The other two charges alleged that between February 1, 2019 and February 29, 2020, the defendant, without legal authority or reasonable excuse, conspired with the manager for the same purpose to provide each other with a monthly cash payment of 2,000 yuan Or 5,000 yuan.
The ICAC investigation revealed that the above-mentioned exempted loans and cash payments were suspected to be involved in a total of 76,000 yuan and 47,000 yuan respectively.
