The Justice granted an exemption from prison to the psychologist

Carlos Ángel "Charly" Díaz

, one of the seven defendants in the cause for the death of Diego Maradona.

The request was made last Monday and is intended to avoid his arrest in case the face gets worse.

The judge of Guarantees 2 of San Isidro, Orlando Díaz, decided this Monday to grant the defense request, according to TN anticipated.

The brief was presented by his lawyers Vilma Paola Carluccio and Diego María Olmedo.

The request coincided with the completion of the work of the medical board that analyzes whether Maradona's death could have been prevented.

In the next few days you could present your findings.

According to the wording of this report, prosecutors could change the classification from "wrongful death" to

"simple homicide with eventual intent"

, a non-jail-free crime that provides for

8 to 25 years in prison

.

The defense based the claim - according to the Télam agency - on his "strong roots, his profession and the inexistence of procedural risks."

The report of the medical board could complicate the situation of the defendants in the case investigating the death of Diego Maradona.

"We cannot fail to observe that we are going through a summary that has particular edges, because the person who has died is perhaps one of the most famous people in the world, no longer doubt one of the most beloved, but the most, in our country ", says the writing.

"That single circumstance -continues the defense-, causes everything to be dimensioned in an exponential way, and various investigative hypotheses are considered both from the formal, in the file itself, and from the media, speculating accordingly with the most dissimilar qualifications ".

Carluccio and Olmedo add that "the commented dimensions of the protagonist make everything be seen from a prism that, strictly speaking, really seems to oversize the object of the case."

Diego Maradona died on November 25 of last year.

"The detention of Díaz would be completely unjustified, because taking into account his personal conditions, there is no doubt that with the imposition of a sworn bond it would be enough to secure his submission to the process", affirm the lawyers.

In another section of the writing, they describe Díaz's career as a psychologist and highlight that he cares for "60 patients" who suffer from "one or two chronic diseases", including people with "problematic substance use" who "need support and permanent accompaniment that is essential not to discontinue ".

This is the

second request

for exemption from prison presented in the case by one of the defendants in the file.

On December 4, Judge Díaz

granted the benefit

to the neurosurgeon Leopoldo Luque, although only in order to qualify as "wrongful death" -with a penalty of 1 to 5 years in jail-, considering that it is an exempt crime and that a sworn bond was enough.

Apart from Luque (39) and Díaz (29), the other five accused health professionals who currently have the cause are the psychiatrist Agustina Cosachov (35);

the nurses Dahiana Gisela Madrid (36) and Ricardo Omar Almirón (37);

Nancy Forlini, the doctor who coordinated home hospitalization for the prepaid Swiss Medical, (52);

and the coordinator of the nurses, Mariano Perroni (40).
