Three weeks after the punitive expedition and the deadly brawl of Marcouville, in Pontoise (Val-d'Oise), the court of appeal released Tuesday, April 21 the father of the young person suspected of having shot Carlos , after hitting Driss, on the motorcycle he wanted to recover.
This 57-year-old man had preceded his 23-year-old son to Marcouville, knowing his "impulsive" character, with the sole aim of "dissuading" him from embarking on a punitive expedition.
An explanation heard by the investigating chamber which released him.
He had been remanded in custody after his murder charge.
His lawyer appealed against this decision.

Pauline confides that she learned this Wednesday of the decision of the Versailles Court of Appeal through the voice of her lawyer, Me Sandrine Paris-Heidegger. “I am shocked by this decision, underlines the latter. The father's defense pleaded, during the hearing of the investigating chamber of the court of appeal, the absence of serious and consistent evidence of his participation in the facts.
Recalling that he was not present in the Master van which hit the young biker, that he went to the scene "with the sole aim of dissuading his son" from recovering the motorcycle and that he did not he was not the author of the shot that killed Carlos, relying on ballistic expertise.
What the court finally retained by estimating "that at this stage, the investigations do not allow to impute to him the existence of material or intentional elements characterizing his participation in the facts as author or as an accomplice of murders".
At dawn, the son thinks of recovering his two-wheeler
The events that occurred on April 1 at around 8 p.m. took place entirely under the objectives of video surveillance. The cameras recorded the arrival of the Renault Master driven by the son, which was carrying two passengers. The van voluntarily collides, while moving on a lane in the forbidden direction, the red cross bike which was traveling in the right direction, in front of the Marcouville district. The shock is terrible, three quarters frontal: the young Driss who was not wearing a helmet flies away before falling, finding death on the roadway of avenue De-Lattre-de-Tassigny.
There follows a scene of a complex brawl in which the driver and his two passengers manage to escape before being picked up by Marcouville's group and beaten.
The driver found on this occasion his father who had preceded him by car on the scene and who had armed himself "in case".
Carlos will then be fatally shot by a bullet fired from an automatic pistol, the one the son had in all likelihood.

The father, who had his gun torn off during the brawl, his son and a friend of the latter who was in the front of the van, will be arrested on the evening of the events.
A few days later, the second passenger of the van surrendered and was also indicted for murder.
He was at the back and initially had to mediate with the young people of Marcouville, some of whom he knew, to get the cross-country bike back.
The investigation by the judicial police also established that the son had contacted his friend at 6 a.m. on the morning of the incident to organize the recovery of the motorcycle stolen on March 27.
He had found traces of it through social networks.
A white march to pay tribute to the victims
The death of Carlos, 33, and Driss, 21, stunned the district of Marcouville, also shocked by the release of the father. Following the decision of the Court of Appeal, the relatives of the two victims decided to organize a white march within a few days, in order to pay tribute to the two deceased people and to express their incomprehension about the decision of the court of appeal. “For those close to us, it is a matter of reminding us that human life must retain value in the eyes of justice.
