Seine-et-Marne: struck off since 2015, the pediatrician continued to practice everywhere in France

2021-04-22T12:06:57.904Z

Despite a definitive ban from practicing as a doctor, a 61-year-old Chellois has increased the number of contracts in hospitals. This Wednesday

He had to be brought back by force in the box of the criminal court of Meaux (Seine-et-Marne), this Wednesday evening.

A few hours earlier, the man had refused to leave the cell of Meaux-Chauconin prison, where he had been in pre-trial detention since March 18.

But the judges absolutely wanted to judge this 61-year-old Chellois, prosecuted for illegal practice of medicine between 2016 and 2021. It is a real tour de France of hospitals that justice accuses him of: Provins (Seine-et-Marne), Compiègne and Noyon (Oise), Gien (Loiret), Vierzon (Cher), Fréjus and Saint-Raphaël (Var), Montluçon (Allier), Aix-en-Provence (Bouches-du-Rhône), Villefranche-sur-Saône ( Rhône), Chaumont (Haute-Marne) or Mulhouse (Haut-Rhin).

Facts for which he was sentenced to nine months in prison, which he will perform under an electronic bracelet.

“I don't want a lawyer for one reason: I shouldn't be here. He's another doctor. Because at the material time, I was not registered with the Order of Physicians. It was he who was responsible for guard that day ”: it is with this long tirade, unrelated to the hearing of the day, that Michel

(the first name has been changed)

began his trial, in a vehement tone. .

The defendant referred to a tragedy that occurred in 2006 at the Kremlin-Bicêtre hospital (Val-de-Marne), where an 8-month-old baby died after being transferred from the Montfermeil hospital (Seine-Saint-Denis) .

This death earned Michel a one-year suspended sentence for manslaughter in April 2015, pronounced by the Bobigny Criminal Court.

A conviction accompanied by a definitive ban on practicing the profession of doctor, confirmed by the Paris Court of Appeal in 2018.

Michel - who worked as a pediatrician in Montfermeil in 2006 - was accused of having made a bad diagnosis, of having clung to it and of having organized a transfer in unsuitable conditions.

Michel had estimated that the baby suffered from an allergy, whereas it was about a fulminans purpura.

Conflicting explanations

The problem is that Michel, despite his removal from the Order of Physicians, continued to work in hospitals. This Wednesday, the exchanges between the presiding judge and the defendant were muscular, the latter intending to give him law lessons. Michel has never stopped repeating, obsessively, that court or administrative decisions have never been notified to him. Except that he has multiplied the appeals following these decisions ...

The sixty-year-old is a litigator, who does not appear at the hearings and writes to the President of the Republic, to the deputies, to associations, to the courts… Sending thousands of emails to hundreds of recipients.

Since March 18, he has also increased requests for release.

All rejected.

Paranoid traits, psychic rigidity, overestimation, errors of judgment: the portrait of Michel, established from documents in the file and a psychiatric examination, is worrying.

"We all see that he has a mental problem"

"Why do you want to be a doctor when you've been struck off?"

“, Asked the deputy prosecutor, Valentine Géraud-Pekly.

The question generated a logorrheic response, in the midst of which the interested party blurted out: “I had the vocation when I was little.

The prosecutor persists in questioning him about his emotions, the defendant himself having lost an 8-month-old child.

Lost sentence: Michel repeats the same sentences mechanically.

The prosecutor requested a year of suspended probation: “When you are a pediatrician and you lose your own child, it's an absolute collapse.

He misdiagnosed a child the same age as his, before making the wrong decisions.

We can all see that he has a mental problem.

"

Not really the analysis of the Order of Physicians of Seine-Saint-Denis, which brought a civil action: "Bad lawyer, bad doctor and bad man", got carried away Me Pascal Gennetay, his lawyer, convinced that the motivation of the accused is to “coin money”.

And to come back to the 2006 affair: “There was a misdiagnosis and no one criticizes him.

The problem is, he refused to admit his mistake and did everything to delay the care of the infant.

"

The lawyer explained how the defendant, who "knows the holes in the racket", maneuvers with hospitals: "He goes through employment agencies.

He provides them with his diplomas, curriculum vitae and copies of the last certificate of registration with the Order of Physicians, which dates from 2016. And no one checks.
