The young girl, a minor, had been able to deposit forged checks in the bank without her parents knowing. She was then

In three years, the family of Océane will have obtained three legal victories.

This 17-year-old girl from Lisses (Essonne) had committed suicide by lying on the rails at Evry-Courcouronnes station on March 8, 2018. A gesture that she explained at length in a four-page letter addressed to his family.

She explained that in February and March 2018, she had been the victim of two crooks - including her boyfriend at the time - in a case of stolen checks.

On April 19, 2021, at the end of civil proceedings, Crédit Mutuel de Corbeil-Essonnes was ordered by the court of Evry-Courcouronnes to pay several thousand euros in damages to Océane's family.

According to the court decision, which we were able to consult, the bank "admits its responsibility at the origin of the tragic death of Océane".

He is accused of having caused damage to others by "recklessness and negligence".

Culpable negligence of the bank

In her last letter, Océane explained that she had deposited checks at the Evry-Courcouronnes bank branch, where she had an account.

In theory, his minority should have stopped him.

“She shared her doubts with her advisor,” explains her older sister, Laurence.

She asked him, in writing, to verify the checks.

But she never got any response.

"

The forged checks are discovered by the director of the Crédit Mutuel agency, who decides to meet with Océane the day before her suicide to explain to her that it is a scam.

He had advised her to go talk to her parents.

But the next morning, she committed suicide.

"How is it that a minor is received without her legal representative?"

», Wonders Laurence.

According to Océane's older sister, “her account was clearly specified that she could neither deposit checks nor exceed a certain limit during certain withdrawals.

However, she was able to do both, without any safeguards.

"

The end of a long judicial epilogue

Laurence is now fighting to prevent fake check scams.

“It has become commonplace,” she laments.

I alerted the Governor of the Banque de France on this subject, to make him aware of minors' access to banking tools.

Banks should no longer be able to get away with saying:

You agreed to deposit the check, it's your responsibility

.

This decision is the recognition of a repeated error.

"

At the time, Océane's boyfriend, Rayan, asked her to cash three checks.

He had explained to the young girl that it was about her wages as a VTC driver.

Rayan then used Océane's bank card to withdraw the money in cash.

But those checks had been stolen.

The crook had even stolen one from his own father.

For Laurence and her family, it is the culmination of a heavy judicial process at the end of which three sentences will have been pronounced.

"I would like to thank the investigators from the Evry police station for their work on these files," she insists.

Océane's family had already obtained the criminal conviction, on October 8, 2019, of the swindler who had scammed his relatives.

Rayan had received a one-year suspended sentence.

He also had to pay the family 15,000 euros in damages.

On September 21, 2020, at the Paris court, a second trial resulted in the conviction of a young man who posted the photo of Océane's mutilated body on the Snapchat social network. The court considered that the broadcast image of Océane undermined the respect due to the deceased, and had ordered him to also pay damages.
