- Geretsried (32) had accumulated nine convictions in the past five years, and he "reliably commits further crimes", as the judge noted.

The defendant stated that he only drove a few meters to explain the clutch to a colleague. Only one of the three inmates had a valid driver's license. This should have driven the van to Quarzbichl, said the accused. The policeman said: "It didn't appear as if the places had been swapped if we hadn't seen them."

"If you want to explain the clutch to someone else without a valid driver's license, you don't do it on public roads," said Judge Berger and imposed a sentence of six months in prison.

"We would take ourselves to absurdity if we were to give another parole," said Berger, justifying his judgment.

It was not until the summer of 2020, a few months before the crime, that the defendant was sentenced to a suspended sentence.

"That shows that he has absolutely no respect for judicial sanctions," said Berger.
