A couple of dealers in downtown Freising drove a lively trade in cocaine and marijuana.

Now both have to go to jail.

County

- A "difficult personal situation" was posted by two drug dealers on Monday in front of the district court as an excuse for their dealings with cocaine and marijuana.

The court of lay judges chaired by Judge Christian Lederhofer was strict: “Other people also go through this and they still don't start dealing right away.” The couple from Freising had about 21 grams of cocaine and around 79 grams of marijuana to various customers last year sold in the city center of Freising.

Each of the two had their own task: The 23-year-old sold the drugs and her boyfriend (36) had the appropriate connections and got the substance.

"There is enough material on the street in Freising"

In Freising this was not a problem anyway, the worker said in court: “There is enough on the street.” According to investigators, both cocaine and marijuana were sold “of outstanding quality”.

The two defendants had already confessed to them during the investigation.

The expected suspended sentences did not materialize, however.

The seller received a prison sentence of two years and four months for illegal deliberate dealing with narcotics in seven cases and illegal dealing with narcotics in not small amounts in two cases as well as drug possession.

There was a "full" confession

The 36-year-old was sentenced to two and a half years imprisonment for illicit intentional dealing with narcotics in five cases and illicit trafficking with narcotics in no small amount in two cases. The indictment, represented by prosecutor Thomas Kunze, was "fully admitted" through the statements of the defense attorney, as was emphasized in court. As for the motive, both said that they wanted to finance their own drug consumption by selling the drugs. At the time, she smoked ten to 15 joints a day and had no job, the 23-year-old said in court. And there was another aspect: When her father discovered drug use, he threw her out of home.

The same thing happened to her 36-year-old boyfriend: his ex ditched him.

Shortly afterwards, he was also fired from his job, said the defendant.

He was "completely at the end".

"I didn't even have a TV anymore." Both defendants asserted that they had finally gotten rid of drug use through detention.

Both have a permanent employment relationship again.

The couple came into the field of vision of the criminal police through the incriminating testimony of a Freisinger who was currently in the focus of the judiciary.

Various surveillance measures followed.

Ultimately, an undercover agent was appointed.

Once she bought marijuana and another time cocaine from the defendant.

"It gets cheaper by the kilo"

The 36-year-old was also present at the second shop.

It would be cheaper by the kilo, he said to the officer.

A third meeting was agreed, which, according to the investigator, was "adventurous": the decoy was guided around a cell phone call and received "very brisk" instructions.

At the meeting point, the officer was then searched to see whether she was wired.

According to public prosecutor Kunze in his plea, this shows that the couple acted with a “high level of criminal energy”.

However, it is mainly due to the large quantities with a high content of active ingredients that he “mathematically fails” to get total prison sentences within the probable range.

Kunze finally requested a prison sentence of two and a half years for the 23-year-old, and a prison sentence of two years and eight months for the boyfriend.

The defense lawyers had started with references to the defendants' own dependence on lower individual sentences and had unanimously applied for a suspended sentence of one year and ten months.

But the jury followed Kunze's remarks.

The arrest warrants remained in place.
