A 76-year-old Geretsrieder, who had looked too deeply into the beer mug in the "summer at home", is in trouble with the judiciary
Geretsried / Wolfratshausen
- He “ate a really fat Wammerl” at home before he went to the festival in September of last year, says the man in the dock. But that was probably not enough as a "base". At around 10 p.m., the “summer at home” ended for 76-year-old Geretsrieder in the sobering cell. Now he had to answer for assault, resistance to law enforcement officers, willful and attempted bodily harm, each in several cases: The pensioner was sentenced to six months' imprisonment, which the court suspends for two years.
Security forces had made two police officers who checked compliance with the Corona rules at the festival, aware of the heavily drunk senior, who ignored their expulsion. "He hung brutally in the railing," described one policeman when he and his colleagues found the man. He could no longer stand and tried to hold on to the barricade. "The way it was hanging there, I would have guessed that it already had five measures."
"Four and a half" was the correct information given by the accused himself. Because he did not want to give his personal details, they wanted to take him to the police station. That turned out to be a little difficult. He tried to hit a colleague, so the man was handcuffed. "We pulled him into the car and pushed him because he absolutely refused to get in," reported the witness. "I was arrested like a criminal," said the defendant. He admitted, however, that he did not remember much of that evening. There is only one thing he knows for sure: “I have not attacked or hit anyone. But I resisted. "
He also did this with passion at the station, as the descriptions of the policemen showed. "He clung to the bars and shook the whole night," reported one. “He put one foot in the door, wanted to get out. The three of us took him back to the cell, ”said one officer. “He wanted out. He didn't understand why he was there, ”says a third. “But the measure was justified. You couldn't leave him on the street alone in that state. "
At the end of the taking of evidence, this was also the view of the public prosecutor, who requested a one-year prison sentence.
However, this could be suspended because the pensioner "lives in orderly circumstances" and had never been guilty of anything to date.
After the incident, the senior personally apologized to the police.
This was reported by the defense attorney, who asked for his client to be "mildly punished".
Judge Helmut Berger did not want to rule out a reduced ability to control due to the strong alcoholism of the man.
He sentenced the defendant to a suspended sentence of only six months.
As a condition, the pensioner has to pay 3000 euros in installments to the foundation of the German Police Union.
