More than 65 proceedings due to the emergency brake law at the constitutional court

The nationwide Corona emergency brake has only been in effect for three days, but the complaints are increasing in Karlsruhe. The FDP is also one of the plaintiffs - and leads studies that are supposed to prove the absurdity of the law.

The Emergency Brake Act has been in effect in Germany since the weekend: If the seven-day incidence exceeds the threshold of 100 on three days in a row, the affected regions must combat the spread of the virus with more stringent measures.

Among other things, curfews at night and contact restrictions on one person per household apply.

The FDP wants to bring these measures down again - and complain to the Federal Constitutional Court against it.

This should be achieved with reference to studies.

"The night curfews and general contact restrictions decided by the Union and SPD are unsuitable measures to combat pandemics," said Deputy FDP parliamentary group leader Stephan Thomae of the newspaper "Augsburger Allgemeine".

Both measures are ineffective and contradictory.

"The available scientific studies show that night curfews contribute next to nothing to contain the pandemic," said the FDP legal expert before the presentation of his parliamentary group's complaint planned on Tuesday.

It is not dangerous to be outside at night, but rather it is dangerous to meet inside, he added.

"Danger lurks INSIDE"

Only recently, leading aerosol researchers from Germany wrote in a letter calling for a change of course in politics. "If we want to get the pandemic under control, we have to make people aware that the danger is lurking INSIDE," said a letter to the federal and state governments. However, there are also studies that prove the success of night curfews. Scientists argue that the point is not to prevent people from walking outside - but rather to avoid them making their way to visit inside.

In addition to the curfews, the FDP parliamentary group also defends itself against contradicting visiting regulations.

"The contact restrictions on one contact person are unsuitable," said Thomae.

According to the ideas of the federal government, a child or grandchild should be allowed to visit its two parents or grandparents alone;

The parents or grandparents are not allowed to visit the child or grandchild together, regardless of whether they have already been vaccinated or not, the FDP politician criticized the lack of logic behind the restriction.

Decision in Karlsruhe still unclear

The FDP is not the only plaintiff.

More than 65 proceedings are pending at the Federal Constitutional Court due to the so-called corona emergency brake of the federal government.

Some complaints are directed against the entire package of measures, others only against individual points.

Among the plaintiffs are the Freedom Rights Society, politicians from various parties and lawyers.

An exact indication of the current number of entrances is not possible because new ones could be added all the time, said a spokesman on Monday in Karlsruhe.

He did not provide any information on when a decision could be expected.
