The defendant Chen Ziquan (36 years old) is a student of the Hong Kong Institute of Vocational Education (IVE). He was involved in an illegal assembly with other unknown persons at the junction of Nathan Road and Argyle Street in Mong Kok on March 1, 2020.

On the night of the incident, more than 30 people gathered at the junction of Nathan Road and Argyle Street and shouted swearing, including "Black Police Die Family" and "X Your Mother Die Black Police".

The witness inspector used a loudspeaker to warn the people at the scene twice that they were participating in an illegal assembly and displayed a blue flag, but the crowd did not disperse.

Another witness, a riot police officer, fired three pepper balls under warning. Most of the people dispersed. After that, the two saw the defendant standing on the road for the first time. In her verdict, she stated that the two police officers did not pay attention to whether the defendant was among the 30 people. The riot police fired three pepper balls before seeing the defendant scolding the police alone for the first time.

For the crime of participating in an illegal assembly, it is necessary to prove that three or more people have disturbed the order, or acted in a threatening or insulting manner.

Liu Guan stated that the defendant yelled in foul language at that time, and appeared successively at different times with the more than 30 people, failing to prove that they had a common purpose and constituted an illegal assembly.

Moreover, he "bringed in large characters to scare and stop scaring." There was not enough evidence to show that he disrupted social peace, so he was found guilty of the crime.
