Wolfratshausen / Munich

- For the second time, the fire of a patrol car in Wolfratshausen's old town concerns a court. At the beginning of the week, a now 30-year-old salesman from Wolfratshausen had to answer before an appeal chamber of the Munich II district court. In January 2020, he was sentenced to two years and four months in prison by the jury in Wolfratshausen for deliberate arson and resistance to law enforcement officers. As before the district court, the man denied having set the police car on fire. He had appealed.

“I smelled smoke and called, 'Hey, your car is on fire.'

They got out there, deleted it and called to me from across the street: 'You are under arrest.' ”The defendant described his memory of the incident in short sentences.

But the scene hadn't happened that easily after all.

Sudden change of heart of a witness

On the night of June 29th to 30th, the police parked their car in front of a gaming room on Obermarkt.

She had been called for disturbance of the peace and a missing person search.

While the officials were talking to the last guests in the toy library, the car caught fire.

The police managed to put out the fire after the fire had spread to the right rear wheel arch.

A local resident, who had previously alerted the police about the noise, recalled hearing that someone was about to set fire to the patrol car. That was supposedly the defendant. During the police interrogation, this was also confirmed by one of his acquaintances, but denied this claim before the local court. However, this change of heart was not taken away from him. The first court assumed that the 30-year-old defendant had lit the plastic sill on the right rear fender of the BMW X1 with a lighter.

"It really wasn't me," the retail salesman claims in the appeal hearing.

The fact that a young man who happened to pass the crime scene on the night of the fire is a possible perpetrator was completely ruled out by the court.

“It doesn't fit together in any way,” it said.

The trial will continue this Thursday with the questioning of further witnesses and the experts.
