The National Audit Commission today (28th) released its latest audit report, which focuses on the registration and management of births, deaths and marriages of the Immigration Department.

The report pointed out that the Immigration Department needs to step up tracking down the whereabouts of suspects in fake marriages. There will be a backlog of 2,609 cases until this year. Half of them have been backlogged for more than two years, up to 11 years.

According to the report, the Immigration Department last year had 2,609 cases of false marriages not completed investigations, and the backlog will be left to this year. Of these 2,237 cases were handed over to the ad hoc team for processing. year.

The Immigration Department explained that there were 1,501 backlogs of cases that had exhausted all means and the suspects could not be found, of which 989 suspects were outside Hong Kong.

84 cases are awaiting review by the prosecution team.

In addition, the Audit Commission found that in 2019, there were 19 and 155 cases that were approved for follow-up and suspension of investigations, respectively. However, the responsible officer only blitzed and checked 18 cases during the year, of which 6 cases were detained by the ad hoc team on average. It was only 1 year before the central administrative team updated the records.

After reviewing the case, the Audit Office believes that the Immigration Department needs to step up investigation of the suspect's whereabouts.

There are cases in which a Hong Kong man was involved in marrying two Mainland women in the Mainland and Hong Kong in November 2006 and January 2007, respectively.

Both wives took this to come to Hong Kong since 2007 with an exit visa for visiting relatives.

Subsequently, in April 2011, the Hong Kong man again passed the civil celebrity of marriage and submitted a notice of intended marriage with a mainland woman, which was withdrawn by the Immigration Department. In November of the same year, the mainland authorities transferred to the Immigration Department and accused the first "wife" to be reviewed. The one-way permit application exposes suspected bigamy.

The Audit Office revealed that the task force’s follow-up actions were “not completely effective,” including five home visits that were unsuccessful. Although they were successfully contacted by telephone on three occasions, the other party never attended the interrogation appointment.

The prescription later entered the suspect's data into the computer system and waited for the opportunity to be intercepted. However, in early 2019, the suspect died in a Hong Kong hospital.

As for the two mainland women involved in the case, they were intercepted by the Immigration Department after being "married" for 7 and 9 years. However, after questioning, the Immigration Department finally decided not to prosecute due to insufficient evidence.

The Immigration Department stated that it would assess the manpower, speed up the processing of backlogs, and strengthen inspections, reminding all case officers to submit the completed case files to the Central Administration Unit as soon as possible after completing all necessary follow-up actions to update the records and It will be archived and written guidelines will be issued to set the target time limit for opening files for general cases.

Regarding marriage registration, as of November last year, the Immigration Department has appointed 2,277 civil celebrants of marriages, but 34 of them are not lawyers or notaries with practising certificates, which do not comply with the provisions of the Marriage Ordinance.

In addition, there are 291 witnesses who have had no service in five years. The Construction Immigration Department of the Audit Commission is considering requiring them to attend refresher courses when they receive applications for renewal of appointment.

The Audit Commission also suggested that consideration should be given to increasing the number of places in the Marriage Registry at Cotton Tree Drive, Tsim Sha Tsui, Sha Tin and Tuen Mun on festive and auspicious Saturdays.

Notification of urging parents to register birth certificate 61 days late

Regarding the registration of births and deaths, all cases have been overdue.

The National Audit Office mentioned that in 2015, a 15-year-old girl who fell from a building died. It was revealed that her parents had never registered the birth of the two sisters, which caused public concern.

As of October 31 last year, there were 150 overdue registration cases, 43 of which have not yet sent the first memo notice to the parents involved. Although the remaining 107 have been notified, 89% of them were delayed by an average of 6 days, the longest being issued. 61 days.

The Immigration Department investigates the case only once a month and calls the same phone number on weekdays

In addition, as of December 15 last year, 7 cases were overdue for more than 6 months, but 5 cases have not been referred to the general investigation team.

The Audit Commission found that the guidelines of the Immigration Department did not contain detailed rules for handling such cases.

The Audit Commission examined 15 cases that were taken over by the General Investigation Team. As of the end of last year, 11 cases had been completed. However, in one case, the officer only tried to contact the parents once a month for four months, and each time they were Calling the same phone number on weekdays and intercepting one of them ten months later, the time limit for prosecution has expired.

In 3 cases, investigations could not be completed within four months and must be reported to the Senior Immigration Officer for instructions. However, there is no record of relevant discussions in individual case files.

The Audit Commission found that the Immigration Department’s guidelines for investigation of such cases did not set a target time limit.

It is recommended to carefully review the requirements for registering death within 24 hours

From January 2015 to October 2020, there were 213,770 natural deaths registered, of which 49% were registered 3 days or more after the date of death.

The Immigration Department stated that the current regulations set a 24-hour limit. Taking into account the spread of the plague in the 1930s, the time limit seems to be very strict in the current situation.

Common reasons for overtime include the failure of relatives to obtain the medical certificate of the cause of death on the same day; and the need to follow up the funeral arrangements and entrust the funeral company to handle them at once. About 93% of deaths were registered within 7 days.

In some special cases, it took up to 655 days to register. The hospital notified that there were uncollected remains, and the hospital eventually handled the death registration.

The Audit Commission recommends that the Immigration Department keep a record of the processing time for death registration and carefully examine what measures can be taken to deal with the violation of the regulations that require death registration within 24 hours.

In addition, the Audit Commission has noticed that the number of birth/death records found has been on the rise in recent years, and it is recommended that the Immigration Department consider including the certified copies as one of the main criteria for controlling officers’ reports to measure service performance.

The Director of Immigration as a whole agrees with the Audit Commission’s recommendations and will explore the possibility of introducing new functions into the new-generation system, which will be activated in phases, to track the processing time of birth registration and death registration.
