Constitutional Court debates requests on the decriminalization of abortion

This Wednesday, the Constitutional Court of Ecuador will debate the claims of unconstitutionality presented by groups of women to one of the articles of the Penal Code that establishes that abortion for rape is not penalized only in women with “mental disabilities”.

There are seven lawsuits filed by feminist organizations, human rights organizations and the Ombudsman's Office that argue that the Penal Code is discriminatory and that it leaves out women who have suffered sexual violence and who do not have mental disabilities, but suffer the effects of a unwanted pregnancy.

The organizations ask that abortion be allowed in the event of rape and guarantee the right of women to decide.

They consider this to be an opportunity for the Constitutional Court to open the way to the decriminalization of abortion in case of rape.

In the event that in the Constitutional Court at least 5 judges vote in favor of the ruling of unconstitutionality, the Assembly must approve the legal reform to the Penal Code.

Anti-abortion activists have spoken out against and believe that life must be defended from conception.

For them, "both lives" must be saved and the possibility of adopting children born as a result of rape must be promoted.

The Ecuadorian Episcopal Conference (CEE) sent a letter to Hernán Salgado, president of the Constitutional Court, expressing concern about the issue and speaking out against a possible decriminalization.
