The prosecution appealed for acquittal of a young man who sexually assaulted a 4-year-old girl: "The testimony of the girl is credible"

The prosecutor's office today (Wednesday) appealed to the Supreme Court against the acquittal of Avraham Leshem, a young man from Katzrin who was convicted of raping a four-year-old girl outside a synagogue in Jerusalem. On appeal, the prosecution noted that the girl's testimony was found credible while Leshem chose not to testify in his defense.
In addition, it was alleged in the appeal that the girl's testimony was not heard at all in court because the children's interrogator forbade it, but the testimony was filmed. It was further argued that he should have been convicted of an indecent act in aggravated circumstances there, and not of a lesser offense of indecent act in public.
About six months ago, the district court acquitted Leshem of rape and he was convicted of committing an indecent act on the girl, near the synagogue and while her father was in prayer.
Last month he was sentenced to three and a half years in prison.
The court allowed the publication of only a small part of the sentence, stating that "in a detailed verdict, the defendant was convicted of a sexual offense committed by a soft child over the years," and sentenced him to three and a half years in prison, probation and compensation of NIS 50,000 per family. The girl.
"The defendant was convicted of an indecent act on a minor, after being convicted of a rape offense in which he was charged, and was also convicted of an indecent act in public," the verdict read.

The girl's family welcomed the prosecution's appeal.
"A small step in the right direction and on the long road to achieving justice in this case. Today our struggle is just beginning," they said.

The credit - and the storm
The rape credit provoked much criticism.
The girl's father said last month that the judges ruled the testimony was unreliable, even though there was a long and orderly testimony of the girl.
"My daughter was not the first but she may be the last to be harmed by him," the father said, adding that after the case was published he received inquiries from other people testifying that their children had been harmed.
"The judges did not bother to see my daughter's strong testimony in the child interrogation that stunned the police and the child investigator in its details. The court chose to escape the rape charge despite the testimony and choose to see it as a first case and a first time mistake," the father added.
