Cai Yuling (37 years old) was charged with two counts of “knowingly making false statements on essentials”, alleging that she knowingly obtained the vehicle registration certificate of the private car LV755 on May 17 and June 10, 2020. Making a false statement means that she applied for a certificate for the following purposes related to traffic and transport matters, to conduct legal procedures and other traffic and transport matters other than the sale of vehicles, in violation of Section 111(3 of the Road Traffic Ordinance) ) Article (a).
She was convicted of both crimes after trial.
Magistrate Xu Qiwei said in the ruling that if anyone pays $45 for any purpose, they can freely obtain the sensitive personal data of the car owner, and the department has no right to refuse, which will have a serious impact on the privacy of the registered car owner.
Xu Guan also pointed out that when Cai applied for the license plate information, he claimed that it would be used for traffic-related matters, but the purpose was actually to interview the car owner. This was not a traffic-related matter, so he ruled that Cai made a false statement.
