The defense of former Minneapolis police officer Derek Chauvin, who was found guilty by a Minnesota jury last month of the second- and third-degree murder of George Floyd, filed an appeal Tuesday to have the trial repeated.
Chauvin's attorney, Eric Nelson, filed the request
alleging that Chauvin's right to a fair trial was affected by the publicity the case had before trial
.
The motion alleges that the court abused its discretion by denying the requests for a change of venue and a new process.
Since the court did not isolate the jury or "admonish them to avoid all media," they were not only subjected to harmful publicity, but also to "intimidation or fear of possible reprisals," the defense said.
