A lawyer for Derek Chauvin filed a motion for a retrial of the former police officer, convicted of the murder of George Floyd.

A lawyer for Derek Chauvin has filed a motion for a retrial of the former Minneapolis police officer, who was found guilty of all counts in the murder of George Floyd on April 20.

Chauvin was convicted of accidental manslaughter, unintentional manslaughter with contempt for life, and unintentional manslaughter in the commission of a felony.

His attorney, Eric Nelson, filed a motion Tuesday asking Hennepin County District Court Judge Peter Cahill to grant a new trial or provide other remedies.

It cites factors such as "interests of justice, abuse of discretion that deprived the defendant of a fair trial, misconduct by the prosecutor and jury, errors of law in the trial and a verdict that is contrary to the law.

The four-page document details a series of mistakes that the defense believes were made during Chauvin's trial and that, in its view, violated his constitutional rights to due process and a fair trial.

These include accusations of errors by Judge Cahill, misconduct by the prosecution and jury, intimidation of witnesses and the impact of publicity.

Publicity during the trial threatened his impartiality, and an expert defense witness was intimidated after testifying but before the jury deliberated, says the document filed with the court.

"The publicity was so pervasive and so damaging before and during the trial that it created a structural flaw in the process," Nelson wrote.

The court also "abused its discretion" by not granting a change of venue or kidnapping the jury, the motion says.

Another reason for a retrial is "that the jury misbehaved, felt threatened or intimidated, felt racially motivated pressure during the trial, and / or did not adhere to instructions during deliberations."
