The white police officer convicted last month of the murder of George Floyd in Minneapolis demanded a retrial tonight (Wednesday). This is on the grounds that he did not receive a fair trial and the mistakes made by the prosecution in the case that is closely followed by the entire United States. Derek Shubin, who last year pinned his knee to the neck of Floyd, a black man, for more than nine minutes until he died, faces up to 40 years in prison after his conviction.



However, the former police officer's lawyer, Eric Nelson, claims that due to the publicity of the case, the 45-year-old chauvin did not receive a fair trial, in addition to court and prosecution errors and "racial pressure" on the jury. Nelson even argued that the jury should have been isolated at the time of the trial and that the case could only be conducted fairly if it took place elsewhere, and not in Minneapolis.



"The publicity here has been so extensive and biased, before and during the trial, that it constitutes a structural defect in the entire proceeding," Nelson wrote.



In a furious response to the move, attorney Ben Crump, who represents Floyd's family, tweeted: "No. No. No. guilty. Guilty. Guilty."

The petition was filed at a time of doubts about the credibility of one of the jurors, after a picture of him at an anti-racism rally was revealed, in which he wore a shirt with a picture of Martin Luther King and it read "Take your knees off our necks" and Black Lives Matter.



Legal experts said Chubin's defense may use this image to base its appeal on the verdict, though it was not mentioned in the application filed tonight.



The same jury, 31-year-old Brandon Mitchell, is one of only two who have identified since the beginning of the media trial.

Before the trial began, potential jurors were asked if they had participated in demonstrations that erupted against police violence following Floyd's death on May 25 last year.

Mitchell said he could not have been impartial.

He told a local newspaper that the photo was taken last August, while attending a rally marking Luther King's "I Have a Dream" speech.



Jeffrey Frederick, an expert on selecting jurors, said Mitchell's answer may be "technically correct" because the incident in Washington was classified as a memorial event.

He explained that the judge would decide whether Mitchell lied during his interrogation and whether there was an impact on the outcome of the trial.

According to him, the continuance of a new trial is extremely high, and disqualification of a jury in similar circumstances is rare.



Steve Toller, another expert on the jury, agreed.

"Judges do not want to declare disqualification, especially in cases where there has been a sentence and they have received special attention," he said.
