Former Hong Kong Zhifeng Wong, Tsuen Wan District Councillor Shum Ao-fai, Southern District Councillor Yuen Ka-wai, and Kwun Tong District Councillor Leung Kai Ching were accused of participating in the June 4th rally on June 4 last year. According to the "District Councils Ordinance", elected members are sentenced to more than 3 months of imprisonment for any crime without a fine in lieu of imprisonment. Regardless of whether the sentence is suspended or not, they will lose their qualifications as elected members, so the three will lose their membership.

According to Article 24 "Disqualification of Elected Member" of the "District Councils Ordinance", if you are convicted of any crime (whether convicted in Hong Kong or any other place) after being elected, and you are sentenced for the crime for a period exceeding Three months without the option of imprisonment in lieu of a fine (regardless of whether or not a suspended sentence is granted) will be disqualified from serving as a member of parliament.
If they file an appeal, the disqualification arrangement will be suspended first, and the government will publish a vacancy in the gazette later. If the district board member appeals, the disqualification arrangement will be suspended.
