It's about tools against speculators and about the slightest chance in the fight for affordable rents.

Tegernsee sees one approach in the second home tax.

The city council was now looking at it again.

Tegernsee

- In May 2018, Tegernsee decided to retroactively increase the second home tax rate to 20 percent from January 1st. All valley communities followed suit. The priority is not to generate income, but rather to push back second homes due to the tense housing situation. Mayor Johannes Hagn (CSU) made headlines across Germany with his pious wish, “We don't want Syltisation”.

Today, Tegernsee is in no way inferior to the celebrity island in the north when it comes to property prices.

The number of second homes could actually be reduced: While there were 470 second homes at the beginning of 2018, the number fell to 451 at the end of the year.

The number of 428 residences at the end of 2019 remained the same until December 2020. "Since then, another 17 second homes have been given up," says Hagn.

The income generated by this will increase by 38,000 euros to 976,000 euros this year, as the current budget report shows.

Treasurer Jürgen Mienert justifies this by registering higher quality second homes in relation to the cancellations.

Rent prices range between 11.38 and 43.04 euros per square meter

The city council was now back to the topic of second homes. In 2018, the administration was commissioned to present an evaluation after two years in order to be able to decide on how to proceed. One of the findings of this analysis is that the situation on the housing and real estate market has meanwhile worsened considerably and the standard land values have risen by 27 percent in average locations since 2018. “We move between 11.38 and 43.04 euros per square meter in rental prices,” said Hagn in the course of the debate and reported on just eleven offers for apartments that he had found in the valley. "If we want to increase our city apartments to eight euros, then we are not even at half the rent that is usual for Tegernsee."

How can Tegernsee intervene further?

The so-called statute for securing the intended purpose of areas with a tourism function, such as Kreuth has in the meantime issued, is not suitable for Tegernsee, said Hagn, and neither is a so-called misappropriation or conservation statute.

The best solution is to continue to work with the second home tax statute.

City of Tegernsee continues to use the second home tax

Andreas Obermüller (FWG) agreed to this.

The statutes are legally secure, easy to understand and bring the city almost one million euros in revenue.

"That's a house number, so we can buy and rent out." The statutes are fair, "in all directions." Rudolf Gritsch (CSU) agreed, thought the statutes were transparent and open.

Ursula Janssen (Greens) described it as an efficient and regulating agent.

Florian Kohler: Articles of Association spread the wrong "message"

Florian Kohler (BürgerListe) was skeptical, he was not convinced of the actual effect on the housing market. And: "With the statutes, the message goes out that there should be no second homes at Tegernsee." That is exclusionary. On the other hand, he thinks it is good that the income is used sensibly in Tegernsee. "Message or not," countered Hagn. “We are discussing because we are elected and our citizens can no longer afford the apartments here. Anyone who thinks they have to have a second home on Lake Tegernsee should please pay for it. ”Hagn admitted that the message might be exclusionary, but it was necessary to curb the“ Monacoization ”. The money that Tegernsee has received so far is used sensibly. It is around six million euros so far,It was used to finance the purchase of a number of apartments. Ursula Janssen thought it was important and right that the income from the tax should be used for a specific purpose.

How Tegernsee will continue to deal with its second home tax, whether it will be increased or decreased, remained open on the evening of the meeting.

The adoption of a statute based on the Kreuther model was unanimously refrained from.

Rather, the administration was commissioned to work on the issue further.

It should be back on the table by early 2022 at the latest.
