- The Senate will begin the examination of the draft constitutional law relating to the preservation of the environment.

I share the positions adopted by the Committee on Sustainable Development and by the Committee on Laws thus drafted: France “preserves the environment as well as biological diversity and acts against climate change, under the conditions provided for by the charter of the environment of 2004 ”.
This wording replaces the term “guarantee” with that of “preserve”.
It takes the advice of the Council of State.
I told the chairman that this position seemed balanced and reasonable to me.
We want to avoid any hierarchy between constitutional principles;
one cannot delegate constituent power.
Finally, beware of mass litigation that the term “guarantee” could lead to.
