The accused is a 36-year-old woman from Munich, who on Christmas Eve 2019 in the Rottach wine bar Moschner in search of her supposedly stolen jacket and injured a bouncer with a punch in the left eye, is not reassured by the police either and ended up in arrest.

Even on the fifth day of the trial, which was supposed to be the last, the defendant did not appear, although the prosecutor had already made it clear several times that she considered the personal questioning essential.

The court ultimately dismissed her request to be shown.

The suggestion of defense attorney Kevin Rebentrost to conduct a further legal discussion on this point, judge Walter Leitner rejected.

The positions are apparently as far apart "as the moon from the sun".

It is therefore to be expected that the proceedings will not end with a judgment at the district court, but will instead be appealed to the Munich II regional court.

There the defendant would then have to testify personally.


Video spotted by police bodycam

The video of a body cam with which one of the police officers had documented the events at the Wiesse office was viewed in camera. It was found that the defendant had abused a total of six times. Rebentrost justified that it was the only way his handcuffed client could defend himself against a situation that was perceived as illegal. He could not see much of their massive resistance, which the officers had described, in the recording.

In addition to a compensation of 300 euros already made to the Bavarian Police Foundation, a settlement with the injured bouncer had come about, the lawyer said.

In a phone call they agreed on compensation of 400 euros, the Miesbacher accepted an apology.


Defense attorney demands acquittal

The allegations against the Munich resident were largely confirmed, it was finally said in the pleading of the prosecutor. Instead of taking responsibility for her behavior, she "bathed in her self-pity to confirm her role as a victim" in the restaurant and later also to the police. An eagerness to burden the witnesses was not recognizable. She asked for a year on probation and a fine, which the defense attorney described in his two-hour closing lecture as "completely excessive". Rather, he saw the wrongdoing on the part of the witnesses. These would often have given contradictory and incorrect statements in order to cover up their own mistakes and to avert criminal consequences. His client was the victim of a large number of illegal measures. As a consequence Rebentrost pleaded for acquittal.The verdict is due to fall on Tuesday.
