For a community that is about to build an extremely expensive gym, this is just the right thing to do.

A woman from Schliersee bequeathed her fortune to the community - with one condition.

Schliersee

- Because Mayor Franz Schnitzenbaumer (CSU) is currently not convening any meetings due to Corona, the municipal council has not yet decided on the budget for this year.

As reported, there is a lot of investment that needs to be financed.

This will make this much easier this year with an inheritance.

A whopping 1.8 million euros in revenue are earmarked for this in the asset budget.

And that's not all: because the house of the testator has been owned by the community for a long time.

Neuhauserin bequeathed a house, a villa and three apartments

Schnitzenbaumer reports how the windfall came about.

As a result, a Neuhauserin initially only decreed that her property on Rauheckstrasse should go to the community after her death.

This with the condition to set up a meeting place there.

The deceased proceeded similarly with a villa on Lake Lugano and three apartments in Berlin.

According to Schnitzenbaumer, the beneficiaries here were the Swiss embassy and a foundation.

But these two bodies waved them off because of the conditions that they did not want to accept.

Thus the municipality of Schliersee remained as the beneficiary of the estate as well as a woman from Gmund.

The estate administrator decided that the inheritance will be distributed among them after deduction of the compulsory share.

The lady had not taken into account her actual heirs in her legacy.

They are still entitled to the compulsory share.

City hall expects income of 1.8 million euros

In addition to the house and large plot of land in Neuhaus, which has belonged to the municipality since 2019, the town hall expects 1.8 million euros, which will flow into the municipal coffers through the legacy.

Only this year because the legal heirs took legal action, but according to Schnitzenbaumer they failed both before the Munich II regional court and the higher regional court.

All that remains is to go to the Federal Court of Justice.

A small catch: Schliersee cannot fulfill the wish for a meeting place in the residential area on Rauheckstrasse.

Unlike the other beneficiaries, Schliersee did not throw the gun in the grain.

"We are in contact with the estate administrator about how we can fulfill the legacy in a different way," says Schnitzenbaumer.

Meeting place in residential area not possible

According to an expert report, the property actually intended for the community, i.e. only the building, is not worth preserving, as Schnitzenbaumer further reports.

What happens to it is still unclear and is in the hands of the municipal council.

The last owner came into possession of the house through her partner, who originally also owned the other properties.

About the woman's motives, the mayor says: “She felt comfortable here and wanted to do something good for the community.”
