Audiences filmed: Éric Dupond-Moretti specifies the contours of his reform

The Keeper of the Seals was the guest of BFMTV to detail his bill "for confidence in the judicial institution" and in particular his plan to film the hearings.

The Minister of Justice Eric Dupond-Moretti was the guest of BFMTV this Sunday, May 16 to give more details on this project which has already caused much ink to flow.

To those who are worried about seeing the emergence of a “show justice”, the Keeper of the Seals first of all wanted to reaffirm his intention:

“It is essential to have confidence in the justice (...) of our country (... ). When I want justice to be filmed, it is so that we can see the reality, the everyday, the harshness of the difficulties ”.

Another argument put forward by Éric Dupond-Moretti:

"publicity is a guarantee of the proper functioning of justice".

In addition, recalled the minister, several conditions will have to be met before deciding to film.

The president of the hearing in question may decide to suspend the recording, he recalled, before specifying that there will be

"no live, of course"

, and that the hearings will not be broadcast. that

"once the court decision is final"

.

The minister announced his choice that these broadcasts be accompanied by an

"educational explanation": "there will be a debate with a magistrate, a police officer, an expert, who preferably did not participate in the trial"

The Keeper of the Seals also specified that only extracts would be broadcast for trials that can sometimes last a week or more: "

obviously things will be concentrated so that there is a program"

The hearings can be filmed as soon as there is a

"reason for public interest"

Abolition of automatic sentence reductions

Eric Dupond-Moretti also defended at length another provision of the text: the abolition of the credit system for automatic reductions in sentences. This system, calculated on the length of the sentence, should not be confused with another system based this time on

"effort"

, defended the minister.

“I want only effort to be recommended,”

he said.

"To encourage the effort, it is to allow us to have some guarantees on the reintegration".

The idea, he insisted, is

"to make the reduction of sentences conditional on effort."

The Keeper of the Seals then gave some concrete examples:

"A boy who does not know how to read, if he learns to read it is an effort (...), working is an effort, detoxifying himself is an effort, depending on what the prison establishment can offer ”.
