Will a municipal tree protection ordinance be issued in Peißenberg?

Most likely not.

In the pre-advisory energy and climate committee, a broad front was formed against the joint proposal by Bündnis 90 / Die Grünen and Bürgerervereinigung.

Peißenberg

- It was a long and intensive discussion that was held in the most recent meeting of the Energy and Climate Committee on the subject of the “Tree Protection Ordinance”. Even during the break from meetings - in Corona times, the deep tunnel hall is thoroughly ventilated every half hour - the debate continued in the open air. But no matter how hard Annette Daiber (Greens) and Matthias Reichhart (Bürgerervereinigung; BV) tried, the political phalanx was against the enactment of a regulation. "Planting trees? Yes, of course. Got trees? Yes. Climate protection? Yes. Tree Protection Ordinance? No, I'm not in favor of that. ”The attitude of Patricia Punzet (CSU / non-party) summed up the panel's tenor.

Above all, the criterion regarding the size of the trunk, which the Greens and BV had formulated as a maximum requirement in their application, caused criticism.

According to this, the felling of trees within the development lines of Peißenberg should be prohibited if the circumference is 60 centimeters or more.

“That is far too little,” stated Manuela Vanni (Peißenberger list).

The former mayor described the entire application as "relatively striking".

In any case, only two larger trees were sawed off on public property during her term of office.

Vannis' conclusion: "We don't need a tree protection ordinance."

"With this we bring people to the barricades"

Jürgen Forstner (Free Voters) argued similarly. Tree protection regulations are "basically a good thing", but he is "not aware that trees are being felled radically in Peißenberg". Bernd Schewe (SPD) was also skeptical: Trees that define the townscape should very well be cataloged and protected. But trees with a circumference of two feet? “We'll bring people to the barricades.” Many private property owners would then no longer plant any trees or would quickly cut them down before the ordinance came into force. "Then the regulation would be counterproductive," said Schewe.

As in the discussion about the ban on gravel gardens, the argument of “voluntariness” played a role again - especially in the ranks of the CSU.

“People should be free to decide whether to plant a tree - and also free to choose whether to cut it again,” said Mayor Frank Zellner.

Daiber, however, held against it: Whenever nature conservation was concerned, the "manslaughter argument" would come with the prohibitions.

In almost every area of life you have to observe regulations: “Please feel free to ask yourself whether a tree protection ordinance would really be such a drama,” Daiber appealed to her committee colleagues.

Clear majority against tree protection ordinance

The regulation would allow exceptions, and it is urgently needed: “There are fewer and fewer plots of land on which trees are planted. We don't want to harass or patronize anyone, but it's about a moment to think about it. ”Daiber gave examples of larger tree felling actions, including at the junction between Bergwerkstrasse and Hochreuther Strasse in front of the kebab shop. Several oak trunks were also felled at the Eberlhof in Rapoltskreut in winter. “That is in the outside area, but many have asked themselves whether it was absolutely necessary,” says Daiber. However, Matthias Reichhart's compromise proposal (“Everyone wants climate protection, but it mustn't hurt”) to draw up a “tree conservation statute” with greater scope for trunk size did not convince the majority of the committee. In its proposed resolution, the committee recommended that the market council reject the adoption of a tree protection ordinance with 9: 2 votes.
