Jürgen Maguhn describes the goals of these statutes on behalf of his Agenda21 colleagues as follows: “With this statute, the city of Freising can regulate that living space may only be used for purposes other than residential purposes with a permit.

It can impose fines on the basis of the statutes or, if a misappropriation is approved, obtain replacement living space in the city of Freising for foreign accommodation or more than 50 percent of the apartment would be used commercially.

Important: A misappropriation permit is not required if the living space can be shown to be rapidly refurbished and only temporarily uninhabited or if the rededication of the living space had already been approved under building law before the statutes came into force.

The urgency of such a statute in a city in which affordable housing is extremely scarce results from a vacancy map drawn up by the Agenda21 project group “Building, Housing and Transport” in the old town, stand empty.
