Rather than far-reaching changes, the text especially encourages ventilation of offices, vaccination and self-tests in companies. “

The protocol has changed very little, these are marginal modifications. The big changes will take place in mid-June

,

the Ministry of Labor

told

Le Figaro

.

We will start discussions with the social partners next week.

"

100% teleworking for trades that allow it with the possibility of returning one day a week on site for employees who so wish, and in agreement with the employer remains the rule until June 9. From that date, teleworking will again be governed by social dialogue between employers and employee representatives. Within this framework, employers will be able to choose the number of days of teleworking that they wish to set up in their company. "

If discussions between the employer and the social partners are carried out before June 9, the new rhythm, provided that it complies with the new health protocol, can be applied from that date

", specifies the Ministry of Labor.

Concretely, an agreement can be found between the employer and the social partners.

The implementation of the new telework rate will then be applicable from June 9, provided that it respects the minimum number of days in teleworking which will be indicated by the new health protocol.

If no agreement is reached, the employer takes back control of the number of teleworking days per week within his company.

This will also take effect from June 9 and on condition that it respects the new sanitary protocol.

A 100% return on site is not yet envisaged by the Ministry of Labor.

Self-tests offered by companies

Until this new deadline, a watchword: ventilate. It is recommended to open doors and windows as much as possible. When the weather does not allow it, the use of an efficient ventilation system is important. The new health protocol also calls on companies to equip themselves with CO2 detectors to measure the carbon dioxide present in the air. The High Council for Public Health specifies that the continuous measurement of the carbon dioxide (CO2) concentration, using sensors, makes it possible to judge the quality of the air. It also stresses the need to open the windows for a few minutes, several times a day, in order to further increase the level of air renewal in the premises.

Another axis to minimize the spread of the epidemic in the workplace, self-tests will be able to be offered by companies to their employees. "

In compliance with the rules of voluntary service and medical confidentiality and with information to the employee by a health professional

", specifies the Ministry of Labor.

With regard to vaccination, the employer must authorize his staff passing through the occupational health service to be absent during their working hours.

Employees will not have to specify the reason for their absence.

The employee informs his employer of his absence for a medical examination without having to specify the reason

”, highlights the updated health protocol.

However, "

apart from the occupational health service, there is no authorization for lack of rights

", states the document which "

encourages

" employers to facilitate employees' access to vaccination.

Finally, mainly for employees who have been on short-time work for many months, support for returning to work as part of an “

internal social dialogue

” is recommended in order to allow the proper “

reappropriation of professional actions that have sometimes not been practiced for many months.

". This privileged support can help prevent accidents at work.
