For them, that was the end of the case.

Then came the advertisement at “ImmoScout”.

Was there a change in use in the Tölz building committee at the end of the day? Fischhaber wondered.

The property went on sale as five holiday apartments and one operator apartment.

Why the new owner is now offering it as rental apartments is beyond his knowledge.

Why the topic is quite explosive and delicate is explained by the fact that in the past there were repeatedly apartments with fixed tourist use that were suddenly offered on the normal housing market: an often discussed nuisance in the Tölzer city council.

The situation on Kettnerweg is not a special case in Tölz

A co-owner of the Krettnerweg property, who does not want to be named, puts the situation very differently. The apartments are being offered with a lease limited to May 30, 2022. This clause was stated in all apartments from the start. Sybille Fischhaber remembers, of course, that this was only the case with the operator's apartment. That has been changed. In fact, the addition was now at the bottom of each apartment under “Other”.

Basically, one wants to continue to operate the holiday apartments, asserts the co-owner, but this is not possible in Corona times.

That is why this interim solution was sought “in order to be able to resolve the great housing shortage in Tölz”.

There have been "an incredible number of inquiries," she says.

She is surprised, she replies to the Tölzer Kurier, that there have been so many inquiries despite the time limit.

“For many, it's probably just about a roof over their heads at the moment,” says the co-owner.

Is this temporary use even allowed under building law? Town hall spokeswoman Birte Otterbach says no. "According to the law, fluctuating use is limited to six weeks." A certain tolerance is common in practice, but from the city's point of view, one year by far exceeds this. And what happens now? Birte Otterbach replies to this question that the city reports any unjustified use to the supervisory authority, i.e. the district office. But any other private person could do that too, said the press spokeswoman. Confronted with the six-week rule, the co-owner, who wants to remain anonymous, says: "Then we'll just take the ads out again." They only wanted to help with the housing shortage.
