Another witness (37) stated that the two sports cars were traveling much faster than permitted (“90 to 110 kilometers per hour”).

Two accused acquitted

The accused McLaren driver admitted to having driven up and down the Kesselberg several times that evening because he was waiting for a free parking space at the "Gray Bear" where he wanted to eat with a friend. He did not remember cyclists whom he had just overtaken. And he just happened to follow the Alfa Romeo once because it drove off the curb in front of him. The two occupants of the Alfa did not provide any information. You have been acquitted. During the trial, it was not clear which of the two was behind the wheel. It was also not found that there had been "agreements" between the defendants to compete. "Not every fast driving is a race", explained judge Helmut Berger, who thought it was only proventhat the McLaren driver “did not drive up the hill at the permitted 60 km / h”, “overtook some cyclists in a terrifying way” and drove too close to the Alfa. He sentenced the 48-year-old to 40 daily rates of 50 euros for attempted coercion.

The prosecutor had demanded tougher sentences.

She had identified the Weilheimer as an Alfa driver and applied for a fine of 2400 euros against him, the McLaren driver was supposed to pay 5600 euros (80 daily rates).

In addition, she had applied to withdraw the driver's license for ten months as well as the two vehicles.
