A 51-year-old from the Freising district was brutally beaten by burglars.
The now accused brothers immediately suspected the victim's environment.
District
- The victim's environment apparently immediately suspected: "It was obvious," said the 51-year-old's brother, who was knocked down by burglars on his property in the western Freising district in February 2020, recently in front of the Landshut district court.
The fact that the perpetrators were supposed to have been the Romanian brothers who are now in the dock was obviously the conclusion drawn by those around the victim immediately after the crime.
The reasons for this: The younger Romanian had already gained access to the property and stole a large amount of cash.
The elder threatened the later victim on the phone with death.
Both the victim's brother and fiancée said they asked the 51-year-old at the bedside about the brothers as perpetrators in February 2020.
He nodded and pointed his thumb up.
Reportedly, the prosecution is accusing the brothers of attempted murder.
In fact, at the beginning of the trial, the younger had admitted both the accused and an earlier break-in at his former employer.
However, his brother was not an accomplice, said the 18-year-old, but an acquaintance.
With this he spontaneously broke into the house on the night of February 10th in order to steal again.
There was no intention to kill at any time.
The fact
When the bedroom was searched, the 51-year-old woke up. His acquaintance had given his ex-boss a heavy blow on the head with a flashlight. The man sustained an open craniocerebral trauma and a fractured skull. "The burglars were back", the fiancée was the first to hear from an employee of her partner after she answered her cell phone at 2 o'clock. The man had passed out after the blow. As he himself reported in court, he woke up "because everything was wet". But he had no pain.
In fact, despite his serious injuries, the 51-year-old managed to visit his employees, who live in a granny flat on the property.
They alerted the police, fiancée and brother.
An employee had found signs of burglary;
In addition, the head injury did not look as if the boss had simply fallen over.
He had therefore assumed a robbery.
The negotiation
Communication with the victim was difficult because speech was severely impaired due to the injuries. Her fiancé made himself understood with nods or shakes of the head and signs, said the fiancée. Like her brother, the 34-year-old stated that they had asked “Was that the D.?”. According to the witnesses, the injured party reacted positively and then several times mumbled a word that both interpreted as "brother". What he had determined that the burglars were the brothers, was not an issue in the hospital, reported the fiancé. Only later did he tell her that he recognized both of them by the area around their eyes. The older one looked him straight in the eye.The defense attorney had already denied the threatening phone call on the previous day of the hearing on behalf of the older defendant. The trial will continue on Monday, June 7th.
