- The Greiling councilor Claudia Hefele-Bauer failed with her urgent application before the administrative court in Munich.

After an uproar because she had appeared at the April meeting without a mask, she had legally defended herself against the obligation to wear mouth and nose protection in municipal council meetings.

However, the councilor does not want to leave the decision on her own and has lodged a complaint, according to the spokesman for the administrative court, Martin Friedrich.

Now the administrative court will deal with the matter.

At the request of the Tölzer Kurier, Friedrich announced on Friday that the administrative court had rejected Hefele-Bauer's application in an urgent decision on May 20.

The decision was made without an oral hearing and communicated in writing.

As a justification, Friedrich stated that the court had classified the obligation to wear a face mask as a measure to “protect the other members of the council and for a break during the council meetings” as legal.

The applicant filed a complaint against the decision at the beginning of June.

This means that there is now an urgent procedure - also without an oral hearing - in the next higher instance, i.e. at the Bavarian Administrative Court.

According to Friedrich, the action brought by the Greilinger is an "individual case".

Similar procedures in relation to local council meetings are "not known" at least in the press office.

Greiling council wants to specify mask rules

The Wolfratshauser lawyer Josef Hingerl, who represents Hefele-Bauer legally, declares, however, that he is looking after another such case in Pähl (Weilheim-Schongau district).

Otherwise he does not want to comment on the decision of the administrative court on request.

The Mayor of Greilingen Anton Margreiter does this with one sentence: "If it had been different, I would have been very surprised." The hygiene concept is to be adjusted in the next meeting on Tuesday, June 8th.

Then wearing an FFP2 mask in the municipal council should not only be mandatory when going in and out, but also at the square.

This has already been done in Greiling so far, but was not yet stipulated in the official hygiene concept.
