 The Legislative Assembly of El Salvador, with a pro-government majority, amended 23 laws to modify the process for electing representatives of the private sector that make up the boards of directors of autonomous and semi-autonomous institutions.

The changes approved during the plenary session, which began on Thursday and lasted until the early hours of Friday, establish that the representatives of the sector will no longer be proposed only by the National Association of Private Enterprise (Anep), but by any union or sector .

President Nayib Bukele said in several tweets that changes are part of democracy and that the private sector will no longer impede the work of his government.

"No more blockades to the development of our country," added the president in one of the messages.

The reforms, according to the pro-government deputies, also include parameters for the dismissal of the members of the boards of directors in case of failing to comply with their responsibilities.

"What should Anep be doing by setting its rules where the public institutions are," said Ernesto Castro, president of the Legislative Assembly, at a press conference.

"They will no longer be able to block," he added.

“We are removing the ideological part of these boards of directors.

We are democratizing them, "said deputy Romeo Ahuerbach, of the Great Alliance for National Unity (Gana), a party allied with the ruling New Ideas (NI).

Criticisms of the opposition

However, the opposition criticized the reforms because they consider that they strengthen the control of the Executive.

«What is being done here is to remove transparency from the management of the autonomous companies.

They are removing the point of control, that's why it is a setback, "said deputy Rodrigo Ávila, from the opposition Nationalist Republican Alliance (Arena).

The National Association of Private Companies (Anep) is made up of 55 unions, of which, according to its president Javier Simán, 96% are small and medium-sized companies.

In a statement, Anep considered that with the reforms approved by the Legislative Assembly, the possibility opens up for companies and people with conflicts of interest to nominate candidates.

"The interest in evading all kinds of citizen comptroller and accountability that other governments tried in the past is taking shape," the statement added.

Same as 2012

In August of that year, the Farabundo Martí Front for National Liberation (Fmln), the Great Alliance for National Unity (Gana), the National Agreement (Cn) and the Party of Hope (Pes) approved reforms that left the representatives out. of the private sector of the boards of directors of the autonomous and semi-autonomous institutions.

The deputies, at that time, delegated the attribution of appointing the vacancies to then-President Mauricio Funes (2009-2014).

However, on November 14, 2016, the Constitutional Chamber of the Supreme Court of Justice declared those reforms unconstitutional.

The main reason, according to the magistrates' ruling, was that the changes were approved with dispensation from processing, without the deputies justifying the urgency for their approval.

Dispositions Needed to Advance

Bukele justified on June 1 the dismissal of the magistrates of the Constitutional Chamber of the Supreme Court of Justice and the attorney general.

"Without the decisions taken, it would be impossible to transform the country," Bukele said during his speech for the second year in office.

The dismissals of civil servants approved on May 1 by the Assembly, with a pro-government majority, have provoked a wave of condemnations from the international community. However, Bukele has said that there is no "going back" on the changes promoted by his government and that while "God gives him strength" he will not allow the Arena and Fmln parties that ruled El Salvador in the last 30 years to return to power.
