The act of strangers in Benediktbeuern caused a sensation at the weekend: They stole the Bavarian flag that was waving on the maypole and instead hung up a flag with an imperial eagle.
The police are investigating - and not just for theft.
Benediktbeuern - After the Bavarian flag was stolen from the maypole in Benediktbeuern and a flag with an imperial eagle was attached, the Bad Tölz police station found not only theft but also an offense under the Administrative Offenses Act, Paragraph 118 - Harassment of the general public. This is what Andreas Rohrhofer from the Tölzer Police said when asked by the Tölzer Kurier.
This paragraph states that it is illegal to act "anyone who undertakes a grossly improper act that is likely to annoy or endanger the general public and to impair public order." As Rohrhofer further explains, the majority of people feel because of the colors of the affixed flag - black-white-red -, the imperial eagle and the writing "Germany - My home" unsettled.
Because numerous neo-Nazis carry the simple black-white-red flags of the empire - knowing full well that they would make themselves a criminal offense with swastika flags.
Acted between midnight and the wee hours of the morning
Since the flag in Benediktbeuern was not an imperial flag, according to Rohrhofer it was not investigated because of the use of symbols of unconstitutional organizations.
The penalty for the administrative offense ranges from five to 1000 euros.
The act must have happened on Saturday night between midnight and the early morning hours.
The deputy maypole master of the maypole boys was informed of the incident around 6.30 a.m. and immediately removed the flag with a colleague.
The boys filed a complaint.
