Nuremberg - The city of Nuremberg tries to fight against amusement arcades and betting shops with all possible means, even if the proceedings are lengthy.

The judgment of the Bavarian Administrative Court of May 26, 2020 (Az. 9 B 17.710) is now final and confirms the Nürnberger Weg to prevent betting offices from not allowing parking spaces to be changed.

The city announced this in a press release.

Nuremberg wants to take action against amusement arcades and betting offices because the gambling addicts are threatened with fatal social consequences and they regularly initiate “trading-down effects”.

Entire city locations can be devalued as a result.

Seven years ago the city had already rejected the application of a shop in the southern part of Nuremberg for an illegally implemented change of use to a betting office, which prohibited further operation.

The Bavarian Administrative Court of Ansbach had dismissed the action brought against it by the betting shop operator in a judgment dated July 1, 2015 (Az. AN 9 K 14.1543).  

The operators then went to the next instance.

The Bavarian Administrative Court in Munich had initially approved the appeal because of particular factual and legal difficulties.

However, this was later rejected because there was no evidence of the required parking spaces.

“The effectiveness of the municipal guide numbers list has been confirmed.

The city can also decide at its dutiful discretion whether or not to conclude a transfer agreement, ”said planning and construction consultant Daniel F. Ulrich.

Due to the “urban planning objectives and concepts pursued by the city”, there is no “entitlement to the replacement of the parking space requirement”.

Ulrich went on to explain that “a deviation from the corresponding requirements” was also out of the question. 

Nuremberg: New court ruling can prevent betting shops from being allowed 

The appeal to the Federal Administrative Court was not allowed, but the operator aimed to do so.

The Federal Administrative Court in Leipzig rejected the complaint on April 22, 2021 (Az. 4 B 27.20) because of the non-admission of the appeal.

The judgment of the Bavarian Administrative Court of May 26, 2020 (Az. 9 B 17.710) is therefore legally binding.

This ensures the Nuremberg practice of preventing betting offices from not allowing parking spaces to be redeemed.
