The city of Dachau was defeated in the auction of a property.

Now she wants to force the new owner to build a daycare center and social housing.

Dachau

- The property at Schleissheimer Straße 45 is huge.

A residential and commercial building as well as a rear building are located in a prime location on an area of 2,469 square meters.

When it came on the market and was auctioned at the beginning of the year, the city offered - with the aim of realizing a mixed use of social housing and daycare facilities on the property.

But the city was defeated, and Schleissheimer Strasse 45 went into the hands of another bidder. And his joy about his auctioned property should have been badly clouded since Tuesday. Because: With a majority of 10: 5 votes, the building and planning committee followed the proposal of the city administration to directly impose a so-called change ban on the property and, in parallel, to draw up a development plan that allows the exclusive use of "day care center and social housing" for the area. prescribes.

The city's arguments behind the move make sense: there is a lack of childcare facilities in the city and if - probably from 2025 - schoolchildren are also legally entitled to a daycare or after-school care center, the shortage is likely to worsen.

In addition, there is already a lack of social housing, and here too the situation is likely to worsen in view of the growing number of residents and rising rents.

According to the city administration, the new property owner has shown little interest in this type of development so far: "The city planning department has received an informal request or a preliminary investigation that only provides for residential development in the form of a residential building on Schleißheimer Strasse and several townhouses in the rear.

CSU city councilor complains of "interference with property"

While the SPD, Greens, Alliance for Dachau, ÜB and citizens for Dachau weighted the public needs higher than the property of the individual, the CSU and AfD voted against this approach.

Gertrud Schmidt-Podolsky (CSU) declared that she “did not want to agree to such an encroachment on property”.

She also asked whether the change of use and the change lock could not have been announced before the auction?

Then, she thought, “we might have got the property right away”.

From a legal point of view, the head of the building authority Moritz Reinhold emphasizes, the step of the city is definitely in order: “The legislature allows that.” Apart from that, the new owner has “now the opportunity to sell to us”. In any case, the city would now make the owner an offer - either to sell the entire property or at least part of it.
