"Already 21 years ago this street was an issue in the district council", Wiesmaier reminded of the first considerations for the ED 99. "And even then the affected communities strongly complained that when planning agriculturally valuable areas should not be affected if possible.

Now, however, the Fraunhofer committee is certain, a lavishly dimensioned roundabout near Grucking, a large overpass and the bypass are planned, eight meters wide and designated as a so-called motor road.

Because the federal government has no involvement in this project, the northern bypass is not declared a federal highway.

It is run as a district road, but with the condition that only vehicles that are at least 60 km / h are allowed to move there.

This means that farmers whose fields are in the vicinity of the bypass cannot drive their tractors or combine harvesters here. In addition, the tenor in the municipal council: How should these fields be reached without huge detours? What will a real estate reorganization that may then be necessary look like? “Fraunhofer is already having a hard time with the ED 99”, the town hall chief continues, “because the space required is far too large for it. And in the present planning there are not even bike paths for the people living here. "

Some municipal councils would like an expert to explain the intended course of the road precisely.

And they cannot understand why the planners insist on the route also in the Fraunhofer area.

Ultimately, the municipal council agreed to reiterate the objections raised in 2014 against the northern bypass and, above all, to review the categorization as a motor vehicle.

Bockhorn: 140 private objections

The letter from a lawyer to the government of Upper Bavaria, in which the municipality of Bockhorn raises its objections to the northern bypass, comprises eight pages.

This paper, which has to be sent by June 28th, has now been presented to the local council.

In addition to these arguments, there are currently around 140 other objections from private senders.

Managing Director Heinz Schoder suspects even more: "A few years ago we even had well over a thousand petitions against the planned new route."

In the lawyer’s letter, the community puts forward some serious arguments against ED 99. So there is no justification for planning this new road. The reason for an alleged necessity is still based on traffic surveys and figures that are twelve years old and not only outdated because of the corona pandemic situation, even "obsolete".

A completely inaccurate classification of this street had also been chosen.

"With a correct classification, a federal road would be required here, at least one state road." Now, classified as a road of the district, it cannot serve supra-regional traffic, "the district is the wrong carrier".

There is also no regional planning procedure, since this is "a project of considerable regional significance".

This should have been done before a plan approval procedure.

Finally, the new construction of the B 388 Erding bypass, now primarily included in the federal traffic route plan, would not make a spatial planning procedure unnecessary.

In addition, massive criticism of the choice of the planned route is loud in this letter. Possible routes through the air base were "eliminated in an inadmissible manner". This would be more economical to implement because of the shorter route length and would be rated as good as the current choice for the protection of water, air, nature and climate. Above all, however, a route through the air base does not require any unnecessary use of arable land. According to the letter, it was "clearly incorrect in weighing up" to have given priority to urban development when choosing the route, although this was also "absolutely adequately" taken into account in Bockhorn's proposal.

Instead, at the expense of the community, at the expense of Erdinger's interests, there is a massive increase in traffic on its streets from local traffic, especially in the small suburbs. An increase in daily vehicles can be expected in the immediate vicinity of the school and kindergarten in Bockhorn. Safeguarding or noise protection measures would not be possible there.
