Since the former Bavarian Prime Minister Horst Seehofer invented the 10H regulation and introduced it in Bavaria, the expansion of wind energy in the Free State has practically come to a standstill.

There are almost no locations that meet the requirements.

10H says that residential buildings must be at least ten times the height of the wind turbine away from it.

Seehofer's successor Markus Söder is sticking to the controversial requirement, the coalition partner of the Free Voters criticizes this, but is otherwise powerless against the larger partner.

At the same time, municipalities have the opportunity to say goodbye to 10H - if they have the courage to do so.

"Wind power" sub-zoning plan is coming

Ebersberg has this courage.

The technical committee of the city council agreed to set up a partial area use plan "wind power".

This set of rules will define the zones in which the city can imagine wind turbines - as I said, regardless of 10H.

All the political groups that spoke at the last meeting supported this approach.

Gerd Otter (“Pro Ebersberg) spoke of a“ consistent progress ”, Jürgen Friedrichs (Greens) recognized a“ door opener ”, Alexander Gressierer (CSU) called the partial area use plan a“ technically proven instrument ”and Christoph Münch (SPD) was pleased that the city "take the helm".

Additional climate protection projects already decided in 2019

Christian Siebel, the city's climate protection manager, recalled that in 2019 the city council had decided on additional climate protection projects for the period from 2020 onwards.

For the first time, wind power was included as a measure in the area of ​​energy strategy 2030.

But because the plan alone will not be enough and the fractions are aware of the resistance in the population to wind turbine projects, they decided to bring a service provider "with proven experience in the field of mediation and citizen participation" on board.

This should create a communication concept and moderate the multi-year construction management process.

Zones for open space photovoltaics are named

The city council not only wants to control the development of wind power, it also wants to shape open-space photovoltaics. Startled by a private application to place a nine-football pitch facility in the idyllic east of the city, the city council decided to plan a concentration area and had it drawn up by the planning association for the outer economic area. The plan, which has now been adopted, serves to localize suitable areas in the urban area and to exclude unsuitable areas as well as to develop uniform assessment criteria on the basis of which applications are examined in individual cases.

There are so-called “hard” and “soft” taboo zones.

Hard zones are existing settlement areas, forest areas, nature reserves, natural monuments.

The soft zones include landscape protection areas, regional green belts, steep slopes and orchards.

In the hard zones it is impossible to set up open-air systems, in the soft zones it may be possible if the political will is there.

The Technical Committee decided to declare the surrounding area, which should be designated as a hard zone, to be a soft zone in order to be able to decide on a case-by-case basis.

According to the association's plan, potential areas were actually only to be found in the main town.

The decision still has to be passed by the city council.
