Miesbach - A 43-year-old Thuringian had to answer to the Miesbach district court for stalking and violating the Protection Against Violence Act.

The retailer reportedly followed his ex-girlfriend, with whom he was with from April 2012 to January 2020, for months after the breakup with messages via social media.

That should also have affected their professional life.

Initially, the Miesbacherin received around ten to 20 messages a day. Over the course of three months, the number is said to have grown into a real bombardment on some days: the disappointed man is said to have sent up to 80 messages a day. When a court order to protect against violence put a stop to verbal harassment, the 43-year-old is said to have sent WhatsApp messages to the mother of the injured party and two of her friends.

The accused made it easy for the court.

At the beginning of the negotiations, he admitted all allegations and explained how the acts had come about.

Due to a serious illness in 2018, he was in hospital for a long time.

His girlfriend visited him every day while he was in the clinic.

“I must have developed an emotional dependency,” the 43-year-old tried to explain.

He always had the hope that "something would come up again".

In 2020 he finally moved out of the shared apartment.

Still, he did not finish emotionally: "I could not imagine that this would be a separation forever." The termination of the relationship was never verbalized.

"The sentence 'It's over' was never uttered," explained the Thuringian.

The ex-girlfriend testified as a witness. The man was very jealous. "It was no longer possible that I would have met friends alone," the Miesbacher recalled. When the 43-year-old fell ill, she sacrificed herself very much to support the family. But afterwards there was no support on his part: “For his hobbies he climbed over hill and dale again, but at home he couldn't help. I wasn't worth that much to him. "

What was particularly uncomfortable about stalking was that the news also made the rounds of private matters at her workplace. The ex-boyfriend then turned directly to the Miesbacherin and apologized for what had happened. It was not his intention to pursue them. A lot has also changed psychologically, "otherwise I couldn't sit in the same room with her," he explained. A short while ago that would have been impossible for him.

The public prosecutor stuck to the fine of 120 daily rates of 40 euros each, fixed in the penalty order. Defense attorney Hofer, who had already appealed the amount of the sentence on behalf of his client in advance, pointed out that the matter was over a year ago. Both parties now went their ways without resentment. He therefore advocated 80 daily rates. Judge Walter Leitner chose the middle ground: he set 90 daily rates as a verdict.
