The defendant Chen Jianda (73 years old, retired) was charged with possession of firearms and ammunition without a license, possession of explosives, and possession of prohibited weapons.
The charge alleges that he illegally possessed a flare gun with two loaders with 6 flare flare, a flare launcher and 26 flare launchers in a unit in Ho Kwan Building, Jordan Road, Yau Ma Tei on January 24, 2020. No evidence related to illegal activities
The judge pointed out that although there is no evidence to show that these items are related to illegal activities, he emphasized that possession of these items is still serious and sentence to prison is inevitable.
The judge considered the age of the defendant and his contributions to society, and the amount of sentence was commuted. In the end, he was sentenced to 7 months of imprisonment for each crime and executed simultaneously
The defendant has a paramilitary background
As for the possession of "fisting", the judge said that perhaps because of the defendant's paramilitary background, he had the habit of collecting utility knives.
The judge accepted that he had no intention of using the charged items and finally decided to fine him 6,000 yuan.
The facts of the case stated that the police searched the defendant’s residence on the day of the case and seized the items involved.
After the defendant was arrested, he said under caution that he had purchased flare guns and other items when he served in the Royal Hong Kong Corps (Volunteer Army) in the early years.
