A resident of Wilmannstrasse is currently building such a prefabricated swimming pool in Unterhaching.

But is that even legal?

The municipal building committee has now dealt with this.

“The best building controller is the neighbor,” said Stefan Lauszat, head of building administration.

At the end of April, the community received images of the swimming pool project from the neighborhood.

And then took a closer look at it.

With a size of 6.35 by 2.85 meters and a depth of 1.50 meters, the swimming pool, at ground level and without a roof, would be “basically process-free”, explained Lauszat.

However, there is a legally binding development plan for the Bayersiedlung from 1994 that defines certain building boundaries - in this case they are “almost exhausted”.

The fact that the future pool owner attached a plan with comparable swimming pools in the immediate vicinity to his subsequent application does not matter: “We took a closer look at the area.

These pools were all set up without permission from public law, ”said Lauszat in a friendly manner.

How to deal with this situation?

“We shouldn't open a barrel here,” said Julia Mittermeier (FWU) with a view of the black-building pools - property prices have exploded so much that residents have to be given some freedom.

Stefan König (Greens) had less of a problem with the pool itself than with the additional 34 square meters of lounging area: "The floor is sealed here, that bothers us a lot."

The building committee unanimously legalized the new pool by exemption, but this was just rejected for the lounging area with 7: 5 votes. The district office has the final say anyway: It could theoretically require the pools to be dismantled - or that the municipality modify the development plan.
