"

He lost all legitimacy to enforce the law

": the Chancellery demanded Thursday, June 17 to the Superior Council of the Magistracy (CSM) the dismissal of a magistrate, indicted for having proposed on the internet to strangers to have sex with his underage daughter.

The Ministry of Justice, through the voice of its director of judicial services Paul Huber, asked that the heaviest disciplinary sanction be pronounced against this magistrate, whose "

failures

" can only lead to his "

exclusion from the judiciary

”. This request for revocation is "

as if I had not existed for 28 years

", defended Olivier B, 55, during the hearing which was held partially in camera, in order to protect the private life of his family circle. The disciplinary formation of the CSM, chaired by the first president of the Court of Cassation Chantal Arens, put its decision under advisement on July 13.

The magistrate had been indicted and placed under judicial supervision in June 2020 for corruption of a minor and "

provocation not followed by effects to the commission of the crime of rape and the offense of sexual assault

", offenses punishable by ten years of 'imprisonment. The case started in October 2019 after a user of a libertine dating site reported that a man proposed that his 12-year-old daughter be associated with sexual antics.

The investigation, carried out with the help of cyber infiltrations, led to the questioning of this magistrate with laudatory evaluations, working as vice-president of the judicial court of Dijon where he coordinated the pole of family affairs.

He admitted the facts, objecting however that they were "

fantasies that he would never have materialized

", according to the report read at the hearing.

A "

traumastism

" following "

a horror file

"

In addition to the judicial information, still in progress, the magistrate has been under a temporary ban for a year and has been subject to disciplinary proceedings since August. "

He is in terrible shame for what he did,

" assured his lawyer, Pauline Neveu. She put forward at length an old "

trauma

" linked to the Bodein affair, named after this repeat offender nicknamed "

Pierrot le fou

", definitively sentenced to life imprisonment for three savage murders and two rapes in 2004.

Representing the prosecution during the first trial of Pierre Bodein in 2007, the magistrate was not followed in his requisitions by the Bas-Rhin Assize Court, which had acquitted its 16 co-accused. “

Haunted

” by the image of a young victim of Pierre Bodein, “

destroyed by a horror file

”, Olivier B “

developed many phobias, typical of post-traumatic stress

,” said Me Neveu. “

A sanction must have meaning. When you're sick, it's not your fault. (...) I therefore ask you to say that there is no need for disciplinary action,

”she pleaded.

Deploring an inability to "

assume

", the director of judicial services hammered that the magistrate had posted "

suggestive photos

" of his 12-year-old daughter, her recognizable face, and had gone so far as to "

propose the rape of his daughter to strangers

”.

From April 2019 to June 2020, he exchanged “

almost daily

” on this libertine site with Internet users, in “

very raw

” terms and sometimes at his workplace, also noted the representative of the Chancellery.

With the "

impact

" of this case, Olivier B "

seriously damaged

" the image and authority of justice, said Paul Huber. “

I really don't feel unworthy of this job, which I love. I think I have been useful and I still think I can be one day,

”said Olivier B, visibly affected. "

If you revoke me, it is also the future (of my three children) that you revoke,

" he told the Council. Between 2007 and 2019, nine dismissals were pronounced or suggested by the Superior Council of the Judiciary.
