Erding - The city of Erding wants a property developer to pay a fee of 60,000 euros for a small playground that cannot be built due to a lack of space.

He had suggested 20,000 euros.

A novelty for the Erdingen city councilors: because a property developer does not have the required children's playground on the property on the corner of Münchener Strasse and Bajuwarenstrasse in Altenerding, where he is planning an apartment building with ten residential units and an underground car park, he wants it from the city for 20,000 euros peel off. In principle, the city councils in the Planning and Building Committee (PBA) had no problem with this, only the sum was too low for them. They voted unanimously for 60,000 euros. It remains to be seen whether the client is willing to pay for this.

"Such a request was not yet available in this precision," said Mayor Max Gotz (CSU) at the beginning of the deliberations. "What we decide today will initiate a lot." City hall lawyer Andreas Erhard explained that according to the Bavarian building regulations, a sufficiently large playground should be created from three residential units. Alternatively, this could be created on a suitable plot of land nearby. A transfer is also possible. Such an application has never been submitted to the city before. In addition, there is no playground statute that regulates a price scale according to size.

“The client's offer cannot be the basis for the decision.

We have to focus on a completely different amount, ”said Gotz about the proposed 20,000 euros.

He recalled the cost of building and maintaining the large playgrounds that the city had built over the past few years.

Burkhard Köppen explained that the CSU was basically in favor of a transfer, because: “Experience has shown that small playgrounds go into disrepair quickly.

It makes no sense to force it. ”On the other hand, the client was able to achieve a great increase in value.

Köppen named 1,800 euros per square meter as a criterion for calculating the transfer fee and thus came to 60,000 euros.

Hans Balbach (Erding Jetzt) suggested considering whether a playground in residential complexes should be demanded at all when a large city playground is nearby.

The closest one on Liegnitzer Strasse is 270 meters away from this apartment building.

A general waiver of small playgrounds in residential complexes is not legally possible, emphasized Gotz and noted: "It would also have been possible to build the building smaller in favor of the playground."

The client had argued that the playground would have to be placed in close proximity to the terraces and would thus impair the privacy of the residents.

In addition, the necessary distance to the ventilation openings in the underground car park cannot be maintained.

According to the client, there is no suitable plot of land for the playground in the area.

Herbert Maier (Greens), a former housing consultant for the city council, was also able to make friends with a transfer, because “experience shows that playgrounds are only built reluctantly, if at all”. The lawyer Erhard was also able to report on this. When asked how big a playground in a residential complex should be, he said that a builder had considered a green area with a wooden seesaw to be an adequate playground for a much larger building.

The city councils agreed to keep the route with the large playgrounds such as in the city park or in Langengeisling.

Günther Adelsberger (CSU), on the other hand, did not want to talk badly about the small playgrounds.

They are manageable for small children and parents.

He had scoured the building regulations and listed what you can expect from such a playground.

However, the councils also agreed that the reality is different.

They agreed unanimously in favor of a transfer agreement with the client and in this case set a sum of 60,000 euros.

The money is to be used earmarked for children's and youth recreational facilities in Erding.

In addition, the administration should develop a playground statute and inquire how other municipalities proceed.
