On Thursday (17th), Security Bureau Director Li Jiachao alleged that Apple Daily had violated the National Security Law and the assets of three related companies had been frozen.

The "Apple Daily" quoted the police as warning that if someone is involved in abetting or financing related crimes, whether it is a company or a subsidiary, they may violate the national security law at any time, and One Media in disguised form assists Apple in distributing food, or also violates the national security law.

However, Tang Jiahua, a member of the guild and senior counsel, believes that any company's funding of the operation of "Apple" is illegal and a misunderstanding, and assisting in grain production does not mean colluding with foreign powers and violating national security laws.

"Hong Kong 01" is inquiring with the Security Bureau whether Next Media’s assistance in Apple’s payment of grain will violate the national security law and is awaiting reply.

Li Zhiying’s assistant and consultant Mark Simon told Reuters today (21st) that because the Security Bureau has frozen the assets of three companies, "Apple" could not provide food to employees and was forced to cease operations "within a few days."

The "Apple Daily" quoted the police warning that any person, company or subsidiary who assists in the operation of "Apple" violates the National Security Law at any time and affects the turnover of funds transferred within the Next Media Group.

Tang Jiahua: Helping the operation of "Apple" is tantamount to illegal and misunderstanding

Senior Counsel Tang Jiahua, a member of the Executive Council, believes that any company funding the operation of "Apple" is illegal and misunderstood: "Hong Kong has the innocence inference. Only after a conviction, the court has the right to stop a company's operation or cancel its registration." He also emphasized that the Security Bureau currently only freezes the three accounts of "Apple" and has not prohibited its operation.

Tang Jiahua also pointed out that among the 18 million yuan in assets of the three "Apple"-related companies currently frozen, it is believed that there is evidence of suspected criminal involvement. Other assets of Next Media Group should not be implicated and can pay employees on behalf of "Apple".

The Secretary for Security Li Jiachao emphasized when meeting with reporters last week that if anyone is involved in abetting or funding related crimes, whether inside or outside the group, the police will definitely pursue the investigation to the end.

He also pointed out that freezing the property of criminals is an internationally recognized practice, and urged the public not to go along with criminals to avoid regret.

Helping operations does not mean colluding with foreign Tang Jiahua: Next Media can provide food on behalf of

However, Tang Jiahua believes that what Li Jiachao referred to at the press conference only involved violations of the law and collusion with foreign powers, not the operation of Apple: "What he said should be that the public should not ask foreign countries to sanction Hong Kong, and that the act of assisting in the provision of food "Apple" operation problems." Therefore, Tang believes that even if "Apple" is finally convicted, Next Media Group should not be held accountable.

Regarding Mark Simon's statement today that a newspaper vendor tried to transfer money to the frozen bank account of Apple and was rejected. Tang Jiahua pointed out that theoretically there will be no such situation, but it depends on the content of the freezing order: "Or the bank is a commercial institution. , Decided not to process related transactions."

Chen Zhenying: Whether it will hit the red line depends on the authorities

Chen Zhenying, a member of the legislative council in the financial sector, explained that there are various states of bank account freezing, and it is not excluded that the three companies involved, including Apple Daily Co., Ltd., Apple Daily Printing Co., Ltd., and Apple Internet Co., Ltd., are restricted from receiving and exiting funds.

Chen continued that if Apple is short of funds, Next Media can actually use the funds under its name to pay its employees' salaries. However, since Next Media is a listed company, it must establish relevant legal relations and documents to account for shareholders.

Regarding Next Media’s assistance to Apple in paying employees’ salaries, Chen Zhenying said that it would be up to the authorities to see whether Apple Daily’s continued operations would be a violation of national security laws.

If it is deemed to be a violation of the National Security Law, Next Media’s payment of employee salaries may violate the law. Therefore, as a listed company, it needs to be accountable to shareholders, and Next Media may not bear this risk.
