In Argentina, according to the latest data released by the National Social Security Administration (
ANSES
), there are 5.2 million retirements and 1.6 million
pensions granted
.
To be part of this group it is necessary to take into account the
years of work with contributions
and the
age
of the people.
For women, it is
60
and for men,
65
.
In both cases, they must have contributed for
30 years
.
However, many people who are part of the informal economy, although they are old
enough
, do not meet all the requirements because they
do not have enough years of contributions
.
In this sense, the
pension moratorium
is a measure that allows
acquiring the years that are needed to retire
.
It is
equivalent to having a minimum (today $ 23,064)
and consists of the acquisition of retirement, but with some
discounts
;
which are to
make up the years without contributions
.
Law 24,476 established a moratorium plan that serves both men and women.

In the case of the
discount
of the moratorium, this will not be forever;
Instead, it
will last for 60 months
, that is, 5 years.
Then the retirement will be charged without that discount.
How do I know how many years of contribution I have registered?
To know the
particular situation
of each person, you can consult the following information regarding their
employment history
, by completing a form in ANSES:
Affidavits submitted by your employers.
The periods registered and your remuneration as a self-employed and / or monotax worker.
Information provided by the provinces transferred to the Nation, if applicable.
The proof of
employment history issued online
does not require the authentication of an ANSES agent.
Workers can also request a recognition of services, which is a
resolution signed by ANSES
with the retirement contributions registered at the national level.
The consultation of the employment history is personal, it is accessed with the Social Security Code to
My ANSES> Work> Consultation of Employment History
.
What are the current plans to retire and what conditions do they have?
1. Moratorium Law 24.476
It requires a
prior
socioeconomic evaluation
.
Covers from 01/01/1955 to 09/30/1993 and from eighteen 18 years of age.
The debt can be paid in cash or in a plan of up to 60 installments
, adjusted semi-annually by the
mobility index
.
In the case of women:
if you recently turned 60, you could enter the moratorium for contributions equivalent to 16 years, and you should have already contributed at least 14 years.
One option, if you do not have those prior contributions, is to delay the retirement request and contribute until the requirement is completed.
In the case of men:
a man who recently turned 65 could declare debt for up to 21 years and, then, the moratorium would be enough for him to retire if he has at least 9 years of contributions already entered.
That way, you would complete the 30 years required for regular retirement.
The 21 years represent the time elapsed between the moment the person turned 18 and the last month for which they can enter the moratorium.
The moratorium plan is also in force, of Law 26,970, which is only for women.

2. Alternatives only for women
The plan of
law 26,970
, of 2014, extended in 2016 is also in force. This moratorium is for women who reach retirement age (60 years, and under 65 years), provided for in article 37 of Law No. 24,241 .
The periods to be included must be
between 01/01/1955 to 12/31/2003
and from 18 years of age.
In this case, a 60-year-old woman must have 6 years of contributions after
December 31, 2004
to be eligible.
The debt may be paid in cash or in a plan of up to 60 installments, the amounts of which will be adjusted quarterly by applying the mobility index.
In the cases of people who have a
widow's pension
, to obtain their retirement they
must pay the moratorium in cash
, without being able to access the payment plan.
According to the numbers managed by the Anses,
more than 300,000 women
between 59 and 64 years old are
of retirement age
, but
they cannot do so
because they do not fulfill the 30 years of services required between their registered contributions and the periods that can be recognized. due to the current moratorium.
"Although the Government recently reported that it
is studying
the possibility of allowing
women who, being of age to do so, do not have any contribution required to access retirement
, through the 'Comprehensive Program for Recognition of Periods of Service by Tasks of Be careful ', there is still nothing arranged. This has to come out by decree or by law and for now there are no more news than that, "the lawyer specializing in pension law,
Silvia Arce
,
clarified
to
Clarín
.
"The truth is that
so far no one can retire without any kind of contribution
. And in Argentina the biggest problem is that many women still do not even have the minimum necessary contributions," he said.
What is economic valuation and why can it be an impediment to access the moratorium?
For a person to be accepted, the Anses makes a socioeconomic evaluation.
In it,
income, assets, expenses and consumption are considered
.
The person who wishes to access the moratorium
should not be collecting any retirement
(national or provincial),
social plan or non-contributory pension
.
If you are collecting any of these benefits, you must renounce them to access this type of retirement without contributions.
On the other hand, as explained by the lawyer Arce "if the person
pays personal property they will be excluded
and if there were
blank
perceptions
of money during the last year
of more than $ 90,000
, too".
"The problem is that the existing moratoriums benefit a very small group of people since they need contributions, and it is also necessary to pass the socio-economic evaluation provided by law."
For a person to be accepted, the Anses makes a socioeconomic evaluation, which can be exclusive.

What is PUAM?

Universal Pension for the Elderly
